As Justice Samuel Alito pointed out in a speech earlier this month, the pandemic has provided us a “constitutional stress test.” He worried that under the current circumstances,” religious liberty is fast becoming a disfavored right.”

The justice made clear that he wasn’t “diminishing the severity of the virus’ threat to public health” or even “saying anything” about whether lockdown rules were “good public policy.” But he was pointing out that “the pandemic has resulted in previously unimaginable restrictions on individual liberty” and that this had happened “by executive fiat rather than legislation.”

The unchecked growth of the administrative state and the rule of unaccountable “experts” long precede the appearance of the coronavirus. But what we have experienced in the last nine months is the sweeping away of legal norms that deserves more than a passing glance, even in the midst of a public emergency.

As in the Nevada case, the question before the courts is not whether states can take action to try to save lives in the midst of a public health emergency. Rather, it is whether politicians, emboldened by the conceit that they have now been given unlimited power by the panic over the pandemic, can exercise it not only in an arbitrary manner but also in a way that specifically discriminates against faith groups.

In several states, religious organizations are given exemptions or less stringent numbers for allowed crowd size due to Covid19, and that is damned wrong.

Religious institutions should have equal rights under the constitution. Atheist don't have more rights than people of faith. If you can open Home Depot then you can open a church.

Most atheists have the sense to wear a fucking mask and pick up their Home Depot orders on curbside deliveries. They're not expecting God to filter out the viral particles in a crowded and poorly ventilated church building.

Also, I know religious people who are doing just fine during this pandemic participating in Zoom services and church meetings, just like all the other rational people.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof

nobody has stopped you from worshiping your god and I would bet you rarely if ever went to church before covid but of course scream about it now

The U.S. Supreme Court on Thursday sided against California Gov. Gavin Newsom's restrictions on indoor religious services during the COVID-19 pandemic. The Supreme Court tossed out a decision from a Central District of California court that upheld Newsom's constraints on houses of worship.

"The September 2 order of the United States District Court for the Central District of California is vacated, and the case is remanded to the United States Court of Appeals for the Ninth Circuit with instructions to remand to the District Court for further consideration in light of Roman Catholic Diocese of Brooklyn v. Cuomo," the Supreme Court stated, according to Fox News.

The justices, with no noted dissents, vacated the District Court ruling against the Pasadena-based Harvest Rock Church and Harvest International Ministry, which has several campuses and more than 160 churches across California. The Harvest Rock Church initially filed a lawsuit against the state in July when restrictions were implemented following a surge in coronavirus cases. The restrictions banned indoor singing and chanting activities.

The Supreme Court referenced its recent 5-4 ruling against restrictions on prayer services in New York. The Nov. 25 ruling that said New York could not enforce limits on attendance at churches and synagogues in coronavirus hot spots, which upset Gov. Andrew Cuomo. The Democratic governor of New York then accused the Supreme Court justices of politicizing COVID-19.
