WASHINGTON — The U.S. Supreme Court ruled Thursday that the Trump administration cannot carry out its plan to shut down the Deferred Action for Childhood Arrivals program, which has allowed nearly 800,000 young people, known as "Dreamers," to avoid deportation and remain in the U.S.

Chief Justice John Roberts was the swing vote in the 5-4 decision, which deals a big legal defeat to President Donald Trump on the issue of immigration, a major focus of his domestic agenda.

Roberts wrote in the decision that the government failed to give an adequate justification for ending the federal program. The administration could try again to shut it down by offering a more detailed explanation for its action, but the White House might not want to end such a popular program in the heat of a presidential campaign.​

In other news, a survey among young people shows the words they most often associate with the two Presidential candidates.

Biden: “old...good...creepy”

Trump: “arrogant...racist...idiot”

That would seem to cover it. Oh, and Trump was about 25 points behind.

Most Chief Justices have more going on in their heads than simply ruling on cases as they come. I suspect there's a couple of factors behind Roberts's "liberal" votes this week:

1. He's always interested in the "legitimacy of the Court" — keeping up the pretense that they're not just a rubber stamp for the Federalist Society. So he's willing to give a bit on issues that aren't as central to his greatest concerns.

BTW, this is also true with a lot of other conservatives when it comes to employment rights for gay and transgender folk. You will notice not too many Republican pols or even people in the administration really complained much about that one. They know it's a lost cause in the court of public opinion — this just 16 years after a presidential campaign where the GOP forced anti-gay marriage referendums onto the ballot in multiple states in an effort to drive wingnuts to the polls.

2. Roberts sees little benefit to currying favor at this point with an administration that's heading down the tubes.

Trump pulled defeat from the jaws of victory...he had legal means to terminate the DACA program, with the law explicitly stating what he had to do in order to end the program.

Trump's short attention span precluded following the law, he opted to short-circuit the process via "executive order" which was contrary to both the spirit and letter of the law. Trump got his 24-hour belly rub from Fox in 2017, but ended up in defeat in an actual court of law today.

Another stinging defeat for the "Cruelty is the point!" Trump administration.

This decision creates 3 paths, 2 of which aren't good for the DACA kids.

Path #1 - do nothing and let the DACA kids continue on in limbo. In reality this is a bad idea because their citizenship legitimacy question needs resolved but the DACA kids can call it a win.

Path #2 - redraft the "end DACA" exec order to comply with the SCOTUS decision. There'll be a challenge to it, but if the EO specifically says it's being done according to the guidelines laid out by the SCOTUS. and it actually does what's required, there isn't much that the lower courts can do about it. DACA ends badly for the DACA kids.

Path #3 - Congressional overhaul of immigration. No one knows what the outcome of that will be but I think we can all agree it won't be pleasant while it happens and someone is going to get royally screwed in the end. Whenever Congress passes legislation on immigration, minorities and immigrants take it in the shorts even if Congress was trying to help them. The current political current doesn't bode well for Congressional "help". Which makes the eventual outcome even more potentially damaging to minorities and immigrants. DACA kids may get the worst of it but the damage will spread across the spectrum to include others trying to get here legally.

He had his shot. All he had to do was be competant and he could have won this one, but he #lost.

It's the same with everything else he promised.

There's no wall, there's no great, beautiful health care, there's no infrastructure, there's no "great" economy, coal hasn't come back, farmers got screwed, China is not beaten, American carnage is all over the streets, the "forgotten man" is now part of the 25% unemployed, in every way we are way worse off than four years ago.

Anyone but a Cultist knows it's because he's just a very bad POTUS. Doesn't follow through on promises, can't achieve his goals, can't make any "great" deals, can't build a wall, can't be competent.

All you can say is "He gets a Do-Over."

It's a temporary victory. They didn't rule he can't repeal and executive order they ruled he didn't follow proper procedure when doing so. Of course Obama didn't either but that wasn't in front of the court.

So where's your condemnation for Obama's ILLEGAL ACT in enacting DACA? Wasn't HE "bad at his job" too?
