I need to know more about this Ramirez claim and what the circumstances were.

I hung out with guys in their dorm rooms as friends all the time. I can envision a scenario where one of them whipped it out by accident or when he was changing and I probably would have laughed or just said Oh Gross, cover it up. Depends on how well you know them and how friendly you are. He could have even shook it as a joke. The mere idea of an 18 year old girl seeing a penis is no big deal.

On the other hand, if I didn't know them that well and say one of them closed the door at the same time then it could become threatening.

Was it in a closed room, was it at a wild, raucous party? All kinds of shit happens at freshman parties for f's sake. Maybe other people were making out and getting half naked? Maybe there was skinny dipping going on? Maybe Kavanaugh truly thought it was in the spirit of the party. Unlikely, but possible.

I would think if there were other girls and guys present it couldn't be a dangerous, threatening "assault."

Just getting flashed by some dude at a freshman kegger is not a big deal imo. Depends on how it happened.

On the other hand I've been flashed when I was alone taking a hike and in a library late at night and I was scared shitless.

How I read it, she was on the floor and he put his penis right in her face. Another male told her to kiss it. She was not just flashed, it was not an accident. She had to push him away from her face. I wish the press would stop saying he exposed himself to her, it was more than that.

When you talk about convicting based on allegations, what about crimes where the only witness is the victim? Are you saying that a victim’s testimony must be corroborated in all cases and in all crimes? If so, what would you accept as corroborating evidence? If not, for what crimes is a victim’s testimony sufficient?

Nobody is found guilty without a fair trial, the presumption of innocence, in front of an impartial judge and a jury of his peers. There must be compelling evidence establishing a criminal act took place "beyond a reasonable doubt," and in a civil case "by a preponderance of the evidence," according to rules of evidence and legal procedure. A defendant has the right to hear the evidence against him, the right to face his accuser, and present a credible defense.

Now, not all crimes can be prosecuted, there may not be probable cause. There may not be sufficient evidence to support a prosecution, or witnesses willing to come forward and testify under oath. or the statute of limitations may have run their course. It happens every day.
