He could. Let's back up to where this started, though. Let's not be moving the goal posts. The phrase you wrote that I called you on was "or at least not objecting to it." I asked for a citation that he was objecting to an investigation. I haven't seen a citation yet. Is he personally objecting to an investigation? Either no or yes. No need to move the goal posts on that question. I don't think he's objected to an investigation--because he doesn't have to at this point. There's no indication that he's being consulted on the question. Others are carrying the water bucket. Why wouldn't he let them?
You're also moving the goal posts on the "going after her" issue. You were talking about him suing her for libel. That's not the same thing in any sense as agreeing "with her on" having "an independent investigation." If he sued her for libel that absolutely would be "going after her."
Can't really discuss the issue if you keep changing the goal posts of what the discussion is.
