In Upholding Muslim Ban, the Supreme Court Ignored International Law

Under the guise of deferring to the president on matters of national security, the 5-4 majority disregarded a litany of Trump’s anti-Muslim statements and held that the ban does not violate the First Amendment’s Establishment Clause, which forbids the government from preferring one religion over another. Neither the majority nor the dissenting opinions even mentions the US’s legal obligations under international human rights law.

The travel ban violates two treaties to which the United States is a party: the International Covenant on Civil and Political Rights, as well as the International Convention on the Elimination of All Forms of Racial Discrimination. It also runs afoul of customary international law.

Both of these treaties and customary international law prohibit the government from discriminating on the basis of religion or national origin. Trump’s Muslim ban does both.

Speaking to PBS News Hour, Olivia Caceres said she was separated from her 1-year-old for 85 days. Once reunited, she questioned whether anyone bathed her baby.

“Olivia Caceres was separated from her 1-year-old son in November at a legal point of entry. The boy’s father, who was seeking asylum, remains detained,” the report said. “It took three months for Caceres to get her son back from government custody.”

In Caceres’ testimony she says: “he continued to cry when we got home and would hold on to my leg and would not let me go. When I took off his clothes he was full of dirt and lice. It seemed like they had not bathed him the 85 days he was away from us.”

Madrid, who is in a detention facility 1,000 miles away in south Texas, said most phone calls with her daughter go that way: a relatively mundane dilemma spirals into a crisis. And there’s not much that Madrid can do, except to stay calm and talk her daughter off her emotional ledges.

In a media call Thursday, led by HHS Secretary Alex M. Azar, the administration said that it had some 3,000 children in its care — a much larger number than the 2,057 he reported to Congress last week. Authorities, he said, had not determined how many of those children had been separated as a result of zero tolerance and how many had simply gotten separated from their parents during their journeys. His agency has brought on an additional 230 people in order to comply with the San Diego court’s reunification deadline, he said, although he could not say how many children had been reunited with their parents so far. Last week, Azar told Congress that 500 children had been reunited.

Trump Creates ‘Denaturalization’ Task Force to Pursue Deportation Against Thousands of U.S. Citizens

If we are taking away American citizenship for fraud, there is one name that comes to mind!

In June, the United States Citizenship and Immigration Services quietly announced a new task force that will investigate “bad” naturalization cases, wherein the agency will hire dozens of lawyers and immigration officers “to find U.S. citizens they say should not have been naturalized, to revoke their citizenship, and then eventually deport them,” according to The Takeaway, from WNYC and Public Radio International.

CNN reports that that the new office in Southern California will review cases and then refer them to the Justice Department, which will then pursue denaturalization proceedings against U.S. citizens accused of fraud.
