Andrew McCabe has been fired...

Sara Carter just reported that McCabe has been heard stating that if he goes down, he's taking everyone down with him.

YES!

That would be refreshing. I'm tired of Washington bureaucrats/political hacks getting a pass when they break the law or the rules.

Good. Watch all these Repubs cut each other down one by one. A Democrat won't have to do a thing. :)

It really is as simple as this:

Members of Congress may forfeit or lose their congressional pensions upon conviction of certain federal crimes under two different provisions of federal law:

1. Under the so-called “Hiss Act,” Members of Congress (and most other officers and employees of the federal government) will forfeit their entire federal employee retirement annuities if convicted of a federal crime that relates to espionage, treason, or several other national security offenses against the United States.

2. In addition to the Hiss Act provisions, Congress enacted, as part of the Honest Leadership and Open Government Act of 2007 (HLOGA; P.L. 110-81, Section 401), and as amended by the Stop Trading on Congressional Knowledge Act (STOCK Act; P.L. 112-105, Section 15) in 2012, further provisions that will deprive Members of all of their “creditable service” as a Member of Congress for federal pension purposes if that Member is convicted of any one of a number of federal laws concerning corruption, election crimes, or misconduct in office. The forfeiture provisions of this law will apply if the criminal misconduct was engaged in while the individual was a Member of Congress (or while the individual was the President, Vice President, or an elected official of a state or local government), and if every element of the offense “directly relates to the performance of the individual’s official duties as a Member, the President, the Vice President, or an elected official of a State or local government.” 5 U.S.C. § 8411(l)(2)(B).

Just to clarify, the words "Members" and "Member" boldfaced above refers to members of the Federal Employees Retirement System. And provisions of the HLOGA make it clear that Members of Congress, the President and Vice President can be members of FERS unless they opt out of the pension system in writing. I point this out to dissuade anyone from arguing that HLOGA ONLY holds members of Congress and elected officials liable to the loss of pension benefits under the law and makes no mention of appointed government employees. Don't be stupid.

Having said that, I don't know what you're whining about Andy. There are only three possible outcomes:

1. The government chooses not to prosecute, in which case you can run around for the rest of your life singing "I told you I was innocent, I TOLD you...!

2. The government prosecutes and you are acquitted, in which case you can run around for the rest of your life singing "I told you I was innocent, I TOLD you...!

3. The government prosecutes and you are convicted, in which case your song is going to be more like "Please put me in a minimum security facility so that I don't get butt fucked by a gorilla."

Since you are confidently predicting #s 1 or 2, what's the problem?

In other news, the judge who took out Flynn before he recused himself is a close personal friend of Peter Strzok. How deep does the collusion to get Trump go?

This is a classic case of "be careful what you ask for." The democrats were so hellbent on smearing Trump that they had no idea where it would all lead. In the end I'm glad they did. Even their masters in the media won't be able to cover for them now.

Can't wait for him to challenge this for being politically motivated and sue, then get everything he worked for.

You know, like that Russian traitor Flynn who did even worse yet still retained his benefits.

Can't wait to hear you whine like a stuck socialist/progressive pig when Flynn's plea is thrown out and the erroneous charge against him is dropped.

The problem lies in the fact that he would have become fully vested tomorrow.

Can't wait for him to challenge this for being politically motivated and sue, then get everything he worked for.

I thought Sessions had recused himself?

More likely than your fantasy is that Judge Emmet Sullivan may very well set aside the guilty plea of General Flynn and dismiss his charges.

Technically Sessions quoted the wrong law when he recused himself, probably under the misguidance of the Obama holdovers running the DOJ. That said, he didn't recuse himself from his responsibility to act on the recommendations of the Office of Professional Responsibility in the DOJ.
