Because the homicide does not fit the definition of either.
I didn't bother to say so, but it's also clearly not an attempted robbery either. No one blitzes their victim from behind, shoots them and then neglects to rob them if that was the intent.
What's your theory here? The guy had the audacity to shoot a human being, but didn't have the gumption to reach for the wallet, watch, or cellphone?
