So North Carolina has struck down an anti-discrimination bill passed by the city of Charlotte. I listened to part of the debate online; the Democrats appealed to human decency and concerns about eligibility for federal funding, while the Republicans spouted the usual transphobic rhetoric but focused on the claim (in the bill's preamble) that muncipalities were overreaching themselves by passing legislation that could indirectly affect everybody in the state. It restricts multiple-use washrooms to those of the appropriate 'biological sex' (as stated on their birth certificate); it also prevents municipalities from regulating employment conditions (minimum wage, hours of work, benefits, etc.). The bill was a direct response to Charlotte's LGBT anti-discrimination bill and the attempt by some places in the state to raise the local minimum wage.

The NC bill defines 'biological sex' as what's written on your birth certificate. The state allows a person to change that designation if they've had SRS and submit a notarized statement from the physician who did the procedure, in effect allowing discrimination against anybody who is not healthy and rich enough to afford SRS. (It is therefore clear that sex = genitals, rather than being some immutable biological feature.) In essence, they're concerned that little girls might see a penis.

Apparently, representatives had five minutes before the start of the emergency session to read the bill because it wasn't available before then.

Complaints about discrimination are received by the state's Human Relations Commission, which is apparently in danger of being defunded.

Ironically, the bill declares that "t is the public policy of this State to protect and safeguard the right and opportunity of all persons to seek, obtain and hold employment without discrimination" because "the practice of denying employment opportunity and discriminating in the terms of employment foments domestic strife and unrest". As a result, "[t]he General Assembly declares that the regulation of discriminatory practices in employment is properly an issue of general, statewide concern" and therefore allows it to "supersede and preempt any ordinance, regulation, resolution, or policy adopted or imposed by a unit of local government or other political subdivision of the State". In other words, they are so concerned with discrimination that they refuse to allow anybody but the state government to address the issue - the state will determine what is discriminatory or not.

Dear friends from Canada and UK,

Bear in mind that many of the state governments in the U.S. are controlled by Republicans. There are all sorts of absolutely crazy bills that get passed at the state level. I see this all the time in Arizona. The Republican state legislators hate oversight by the federal government, but they feel perfectly fine about dominating municipalities and counties within their own state.

This NC bill is probably one that will eventually end up in a federal court, perhaps the U.S. Supreme Court, because it involves civil rights.

...meanwhile, some jurisdictions have no system for amending the birth cert even with SRS, and I'm pretty sure there are some that will allow amendment without SRS. So this won't even achieve the "penis-free zone" policy they're after, unless they plan on blocking visitors from places that have different rules about birth certificates.

(Legislature passes poorly-conceived anti-trans bill that is utterly ignorant about how such things work? INCONCEIVABLE.)

Looks like this one is unlikely to survive a Supreme Court challenge, but that'll take time.

From what I've read and heard, this piece of legislation appeared on the agenda at 10am and then the state governor rubber stamped it the-same-day. So if you are trans in NC, you are pretty much illegal.

Disclaimer - I like the Americans I've met in real life and I've been there twice for extended periods of time, but...

this comment sums up pretty much what one might expect from that part of the world where they had The Scopes Monkey Trial (I know that was Tennessee not NC but it's spitting distance as far as a country the size of the US is concerned).

Speaking as a US citizen... um... we're not all bible-thumping gun-hugging young-Earth creationists. But rather too many of us.

I had a brief period of being more embarrassed for Australia, back when we elected the village idiot as PM, but now I'm back to wincing America-wards.
 
Arizona passed an anti-immigrant law that was subsequently struck down in federal court, costing the state a huge amount of legal fees. This hurts greedy and small-minded Republican right wingers in their budget cutting efforts. It takes a while to correct these things.

Arizona was also subject to a boycott when they refused to recognize Martin Luther King Day. Another costly consequence to money-obsessed Republicans. That took a long time to resolve, also.

When North Carolina starts violating the civil rights of people, it will probably cost them a lot of money in the long run, and ultimately they will lose. They want to be known as a high tech center, but will not be able to pursue that vision if they keep pandering to the fear and anger crowd.

This legislation is doomed anyway and struck me more as a desperate re-election bullet point.

"Yeah, we're ranked worse in education, income per capita, and unemployment since I took office, but look how I supported legislation that you agree with as an undereducated and underemployed bigot."

The restroom portion initially seemed laughably unenforceable and biologically pointless. Are they worried that the seat might be left up and that North Carolinian women are too dumb or too gross to even look before sitting in a public restroom? It did make me want to drive cross country to try my hand at using a urinal and see what would happen. (Goodness knows I've used a stall in a men's room before when a line was too long or the cleanliness too poor.)

It really wasn't until a friend asked me what I'd do if I saw a "whites only" sign on a restroom door that I realized how pissed I should be about that section too.
 
NC attorney-general Roy Cooper has refused to defend the law against challenges, using some pretty strong language (although no specific mention of transgender people beyond "LGBT").

There may be a political angle there (Cooper is also the Democrat candidate running for governor against McCrory) but IMHO, if the climate has shifted enough that defending trans people is seen as a vote-winner, that's something to celebrate.

To quote Talking Heads "Same as it ever was". I've always been amazed by the way the US can be a leader in advanced technology whilst simultaneously still trying to drag itself back to the Middle Ages.

Mind you, look at the UK, our government still harks back to "The Good Old Days" of Victorian Poor Houses :rolleyes:
