You might but your state is run by hyper religious evangelical Christians who think the Bible > Constitution....or that Moses wrote the Constitution and about 20 other bat shit things I've heard from southern republicans and their firm belief that the USA was made by evangelical Christians for evangelical Christians and fuck everyone else who doesn't agree with their religion.

No, they really didn't have anything more important to do than get rid of a law that is only used to gain access to a person's life records. They cannot pass any laws because it's a Tea Party Leaning Senate and House of Delegates and a Liberal Democrat Governor.

I don't know when they last used it. On its own, they cannot use it because they are not permitted to go into a bedroom or house to gain proof of adultery.
What it does allow them to do, is bring someone suspected of another crime in for questioning and to establish probable cause for a search. A person tells the police that her drug dealer is sleeping around - and ding - you have a crime in progress giving them a way to arrest him and get a search of his residence.
Virginia's top law folk have argued the "It is useful in conjunction" bit with most of the old blue laws as they are being repealed. They like having an extra hook to toss out there when they are investigating someone. They argued that same argument about the Sodomy law and others - that repeal would take away useful tools for prosecuting other crimes.

I had a case involving a lesbian girl and her lesbian teacher. They were in love and wanted to live together. But Ma said NO and the lesbian community in Tampa hadda conniption tho Ma couldn't legally consent to the minor/adult sexual relationship. It didn't stop your team from stirring up the shit where it mattered, and I was commanded to file child abuse charges against Ma....for emotional stress. And lemme tellyuh the whole fuggin planet got behind the girl and her luvver. But it couldn't be! The judge looked at me and said WTF, and I replied, THE STATE WANTS A MINOR CHILD TO RESIDE WITH HER ADULT LESBIAN LOVER, AND MA SAYS NO.
The judge says, YOURE SHITTING ME, RIGHT?
And I look at the state's lawyer and ask, ISNT THAT WHAT WE WANT?
The judge dismissed the case against Ma, and the lesbians were not happy.
No, it would have been removing a useless and bad law from the books. Keeping it on the books is nothing but a show of "We are Righteous Crusaders for God".
that's an anecdote that has nothing to do whatsoever with the Virginia Assembly and their refusal to repeal the Adultery law.
I didn't bring up anything about "me" or about "lesbians" or "gays". I reported only the basics of why our very conservative delegates and senate did not repeal this law.
