Last night, watching TV with LOML, this 13 yo girl has a baby...LOML is on about how the boy should be charged with rape...I reminded her that the boy was also 13 and maybe the girl should be charged also....this really upset her and that was the end of the conversation.

When I was going to school, 13 or 14 was the age to have the first sex. At any school. I was late with 17. Surprisingly, no girl got pregnant about it.

It's underaged sex, only in harder cases it's called statutory rape. And there are men who won't go to jail for that, of nearly the same reasons.

It's weird jumping into this but I'm stuck at home with nothing to do, so why not.

I don't know if you're an English-speaking German national or an ex-pat or what but, in the US, the nature of the case or the sex involved is kind of irrelevant. If you are the age of consent and so much as knowingly interact in a sexual way with somebody under it, you've committed a crime in a lot of jurisdictions. If you actually have sex with the person, you've committed a crime in all of them. It's pretty simple and straightforward. And people here are sticklers about it. Let me go show some examples:

The age of consent in your state is 18. You take a business trip to a neighboring state it has an age of consent of 15. You fuck a fifteen-year-old while there. Have you done something you could be prosecuted for if there is a way to prove you did? Yep.

You show your dick, on camera, to a person below the age of consent. Are you going to get a visit from the cops if someone who doesn't approve finds out and alerts them? Yes. (In some states, distance matters, i.e. actually traveling to visit them or enticing them to visit you can either seal the case or at least strengthen it.)

You're chatting with someone on Lit or an IM service who informs you she is underage and you continue to engage her in a sexual way. Are you doing anything illegal? In a lot of states, yes.

Im a German living in Germany. Laws here aren't that much different in this case.

And I don't deny the criminal part of underaged sex, though I see some of it just as trivial offense. My point is that underaged sex isn't always statutory rape, and even if it is , it isn't the same as rape. I know if I read a love story or a rape fantasy, I see the difference, and I take it seriously that love isnt rape.

While, in legal language, it isn't called "statutory rape" all that often, it isn't an incorrect term. Rape is the act of making sexual contact with a person who hasn't granted you consent. In the eyes of the law, minors are unable to give legally binding consent on anything--including sex. So, according to the statutes, it's rape, hence "statutory rape."
