So, I did a little checking and Clarkson neither wrote or produced the track, so the lion's share of the guilt will be put on others. If Jimmy Eat World sues I think they will probably win. The damages will be based on the revenue of the Clarkson version of the song and its future earnings.

The problem is that there are only 12 notes in western music, and we (mostly) only use 8 at a time. It's quite easy to nick something without even realizing it.
