NY Times reporting tonight that prosecutors are seeking to bring felony espionage charges against disgraced General David Petraeus.

Top secret classified information entrusted to Petraeus was found by FBI agents on his fuckbuddy Paula Broadwell's laptop.

Petraeus declined a plea bargain to spare him the ignominy of a trial, essentially daring prosecutors to bring legal charges.

Senator John McCain was naturally aghast. Given his history as a military officer and an adulterer, I suspect he feels a great deal of kinship with Petraeus.

In the spirit of full disclosure, you might have mentioned this "fuck buddy" is a high ranking military officer with a top secret security classification.

That still doesn't mean you give out random information. Both of these people were (apparently) smart enough to get where they were, they should have known better than to do this.

At the very least Petraeus should have sought legal advice, both civilian and military, before giving out the information.

I've seen nothing in print about Fuckbuddy Captain Paula's purported top secret security clearance, so in the absence of proof I'll assume this is another one of your fantasy stories, not unlike your "fucking my granddaughter" one.

In any event, even if your assertion was true (and it's not), a top secret clearance isn't the same level of access as that of the director of the CIA, which Petraeus was at the time.
 
He probably has the authority to authorize her to be "need to know" on about anything he knows. Somewhere there is probably a distribution list and he could have put her on it, and probably did not. The main problem is likely a violation of security protocols in removing the documents (electronically or otherwise) from the secured facility where they were supposed to be housed.

Seems a curious thing for him to do. Why? Was he showing off? Seeking her input to legitimize (in his mind) the rationalization for keeping her around?
 
A top secret clearance, does not entitle one to view top secret material, unless one has an actual need to know. So despite the possibility of having such a clearance does not mean she had authorization to view it, without a need to know. The General as well may have been in violation of the law if he removed classified material from authorized working spaces, or provided it to others without a need to know. He like all personnel who handle classified information are required to sign a Classified Information Nondisclosure Agreement
(NDA)(SF 312), a violation of which can result in severe penalties.

Even if she has (or had) top secret clearance and a need to know, having such documents on your personal laptop is extremely stupid. I'm assuming it was her personal laptop because she was in the reserves and was writing a book about him for Penquin.

Of course, opening yourself up for blackmail (having an affair) is pretty stupid when you have access to top secret documents and/or are in the CIA.
 
Love and sex, trumps common sense, it seems. There are strict procedures for the transport or transmittal of highly classified material. He could have been authorized to be in possession of it himself, but my understanding is it might have been on an unsecured personal computer, which would be a violation of handling procedures.

The general has denied giving Paula Broadwell classified material, so the government must be asking how she could have been in possession of certain materials, and I suspect they already know the answer to that question.

My personal opinion is, it remains to be seen what the general did, or did not do. I highly suspect that politics are at the bottom of this affair. It may have to go to trial before we know the real truth, or whether or not the government is just trying to keep in in line or reasons yet unknown.

The whole sad affair points out that given the right set of circumstances, anyone can get caught up in one. Having read about his background, knowing people that made similar choices in life that he did, you have to know personal honor is important to him. He clearly is a man of great fortitude and seems to have exercised great personal integrity and made a lot of sacrifices in all the other areas of his life.

There is a lesson there somewhere. I doubt many will see it, though.

There is no code of personal honor that I'm aware of that allows you to fuck around on your wife.

Exactly. And he spent the final two years of his active duty military career with Broadwell tagging along at every stop, purportedly writing his life story. There was (and is) no hard and fast evidence that he was fooling around back then, but knowing what we know now, it's pretty obvious he's been doing this for a while.
 
In the military, unlike other aspects of civil service, an officer can face court martial for the mere "appearance" of wrongdoing, it called conduct unbecoming. The General, as valuable of an American military asset he may be, may have violated Art. 133 UCMJ, for which he could suffer Dismissal, forfeiture of all pay and allowances, and confinement.

Yep, that regulation is definitely on the books.

Enforcing it, though, is a completely different matter.

Both Petraeus and McChrystal deluded themselves into thinking they were "larger than life", and engaged in some pretty self-destructive behaviors because they thought they were beyond accountability. To a great extent, they did get away with it, both of them now receive their military pensions and suffered no harm from their misconduct.

At one time, yes, it probably was.
"Is"? Maybe to you. To me, and probably many others, it's not personally honorable to cheat on your wife or provide secret documents to someone writing a book for the public.

So your personal opinion is that the FBI (or some other government agents) fabricated emails to Jill Kelley and then planted top secret document(s) on Broadwell's computer. :rolleyes:
