Yes, because Lit would be functioning as a provider. It doesn't matter that they had nothing to do with the creation of the content. They're putting it out there where it can be seen.

For example. Bob has child pornography on a website. Bob has never engaged or witnessed any sexual acts with a child in person, ever, but he puts images he's found on the web on his site.

Bob is still liable for hosting the images.

Then the entirety of the AmPic forum should cease to exist, since Lit has no way of verifying anything with regards to the images posted in it.

But, the problem is not only in the inconsistency with which things are carried out, but the inconsistency in the rules that are laid out. For example, in this forum it now says:

Update: Linking to explicit content can get Literotica just as sued as displaying the image in your post. Literotica gets sued = no more literotica. Please follow the rules.

In the AmPic forum, however, it says:

It's possible to post pics that are against forum rules.

Find a pichosting site, where it's allowed to upload the sort of pics you want to post
Upload the pics
Copy the link provided from the site

I don't know which pic hosting sites can be used, but I'm sure there are some out there.

So... which is it? The entire reason I was linking to stuff in that thread instead of just posting it was because of those rules, which are in the sticky at the top of the AmPic forum. But now those rules are, apparently, the wrong rules.

AmPic must follow the same rules which basically states the following:

- Legally, we can allow soft nudity, but under current United States law, photographs (does not apply to non-photographic images) posted on this site may not contain "sexually explicit conduct", which the government defines as:

- Actual or simulated:
(A) sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex;
(B) bestiality;
(C) masturbation;
(D) sadistic or masochistic abuse; or
(E) lascivious exhibition of the genitals or pubic area of any person. We're talking about the close-ups, or any pictures where the genitals or pubic area is the center of attention, or part of any simulated masturbation. Artistic full nudes are fine, so long as they aren't spread shots and the person can't be masturbating or simulating masturbation

- All persons in all adult-themed photographs must be over 18 years of age.

- Image must not contain URL or other advertisement.

- You must have a legal right from the copyright owner to post any images - i.e. photographs/drawings that you yourself created and/or have a license or other permission to post.


What I think needed to be re-enforced with what is written in Ampic, should have been stated that in conjunction with (what I have in blue). The rules in Ampic probably could have used an overhaul to be better defined. *drops two more cents in the jar*
 
I think, where the semi-loophole exists, is that posting a link is not posting an image. Just like if I link you to a YouTube video I've not actually posted the video, the same would, I would think, apply with an image, whether sexual in nature or not. Which is why people posting in AmPic are able to get away with doing it that way.
 
Honestly, I don't know why I'm polite at all. Even when solid and adult points are made the most juvenile responses are given. There's a reason I treat you all like miscreant children. You sound like them.
