All Roberts did was give you a choice: Buy insurance or pay more into Medicare via a payroll tax. The House has gotta turn that language into legislation to define and quantify what tax, if any, to impose. It wont be ready by 2014.

Huh? Maybe I'm missing something ...They upheld the law as is - so the taxes/penalties/fees/whatever are already determined. It's 2.5% of your income.

It's in the best interests of America to have everyone take at least some responsibility for their own health care, ergo, we have Obamacare with its carrot-and-stick approach.

It's also in the best interests of America to allow everyone who is eligible to vote, without artificial Republican-supported roadblocks like literacy tests, property tests, and/or voter ID tests.

Senate Republicans To Use Reconciliation In Attempt To Repeal Obamacare…




Go for it. Obama and the Democrats used reconciliation to jam Obamacare down our throats because they didn’t have the votes to pass it after Scott Brown’s Senate win.

Now that the Supreme Court has ruled that Obamacare’s health insurance mandate is in fact a tax levied on those who do not purchase insurance, Senate Republicans will look to repeal the full law through the budget reconciliation process.

Reconciliation was used to push Obamacare through the Senate in 2009. Generally reserved strictly for budget-related measures, it eliminates the possibility of a filibuster, meaning Republicans would only need 51 votes to repeal that portion of the law – or even the full law itself.

Sen. Jim DeMint (R-SC) seemed open to that approach during a speech at The Heritage Foundation shortly after the Supreme Court handed down its decision. The court’s ruling “does present some options for us” to pursue more unconventional options for repeal, DeMint said. He mentioned reconciliation as a potential avenue.

A senior Senate Republican aide involved in the repeal effort later confirmed to Scribe that the GOP will use the budget reconciliation process in an attempt to repeal the full law, not just the portion requiring all Americans purchase health insurance.

While a repeal effort via reconciliation would only require a majority of senators to pass, Republicans will likely wait until next year to employ the tactic.

Senate Republican Whip Jon Kyl (R-AZ) said he expects Republicans to use reconciliation in the repeal effort during the 113th Congress. Kyl is not running for reelection.

I don't think either party is suggesting that we go back to "the old way". It's pretty well-established and agreed upon that the old system was flawed and needed to be fixed. There is just disagreement on how to fix it.

I disagree. The Republicans have abandoned their "repeal and replace" rhetoric. Their goal now is simply to repeal Obamacare, which by definition would be a return to the "old way".

Two and one-half percent is the 2016 figure. But ObamaCare has problems that must be corrected to conform with the Courts standards:

I read Roberts opinion, he says Congress has an enumerated power to tax, and construes the penalty as a tax, but he also throws out the penalty as illegal because Congress expressly decriminalizes the act of not buying insurance; the IRS cant throw you in jail or penalize you. So Congress must correct the law's language to conform to Roberts standard. And that places the 'tax' exactly where I say it is, cuz so far only Roberts sez its a tax, the penalty in the law being illegal.
