Court Ruling Declaring the Defense of Marriage Act Unconstitutional

May 31, 2012

A federal appeals court in Boston found on Thursday that a U.S. law defining marriage as a union between a man and a woman unconstitutionally
denies federal benefits to lawfully married same-sex couples in a ruling that promises to push the issue of gay marriage to the U.S. Supreme Court.

The federal law, known as DOMA, defines marriage as a union of a man and a woman when it comes to federal laws and regulations, consequently
limiting federal benefits such as Social Security survivor benefits and the ability to file joint taxes to heterosexual couples.

The Obama administration has said it will not defend DOMA in the courts. But the Republican-led US House of Representatives
stepped in to press the Circuit Court appeal. And it is now likely to take the case to the US Supreme Court.

What will happen, after this Summer is over?

What happens next in the courts? Who can say? The political/electoral implications are more interesting. Obama has already staked out his position on this . . . and this decision now makes it too salient issue for Romney to ignore . . . so what does he do?

I'm sure he will continue to push for denying a certain subset of Americans equal protection based solely on their gender.
If elected he will push for a amendment to the constitution to specifically deny them rights and protections.

If he succeeds I believe it will be the first amendment to specifically deny a minority of US citizens certain rights solely because they are a member of that minority. It will be like a constitutional amendment to deny redheaded citizens from attending accredited colleges.

Just a guess, but I think Americans are more concerned about feeding its gay kids than fretting about the kids weddings.

If R-MONEY had an ounce of brains his campaign theme would be, THERE IS NO TIME FOR THAT!
