Oh, it gets better. Not only can you be arrested, thrown in jail, and then stripped searched by our increasingly corrupt justice system for spitting on the sidewalk or walking your dog, you cannot sue even if they are proven wrong.

I heard this as I as driving home from work today. The man who initially brought the lawsuit was wrongly jailed because a computer glitch failed to show that he had paid a fine within the allotted time frame. He was strip searched twice while incarcerated. For not paying a fine that he actually had paid.

As much as I dislike the current makeup of this supreme court, I really, really expected them to come out in favor of individual's rights. There is no excuse I can possibly imagine for strip searching people who are jailed for crimes, or alleged crimes, that involve neither violence or drugs.

I don't think this is going to make much difference. Every state has had standards to perform strip searches and it is not all that hard to come up with an acceptable reason to do it. To do a strip search you must do it so that the arrestee is not in front of unnecessary personel and other prisoners. It must be done with a modicum of privacy. This puts a manpower burden on Correction personel, and to be honest, Correction Officers do not like to do it very much, so I doubt seriously if it is done much more often than it is now.

Apologies for not having read the link... As I'd heard the story on npr, I'd no idea how much I'd missed. Such as this little tidbit: "Breyer noted that people have been detained and strip-searched for offenses as minor as driving with an inoperable headlight, having outstanding parking tickets, violating a dog leash law, and riding a bike without an audible bell. None of these people could have anticipated being arrested, he said, and none would likely have hidden weapons inside their body cavities."

Now add the fact that more and more jails are being turned over to for-profit organizations for management..... It is surely a recipe for more and more invasions of privacy and loss of personal rights.

Truth is, we've been transitioning into a fascist police state for years. Now, they no longer try to even hide what they are doing: out and out brazen behavior.
