DOMA ruled unconstitutional - again

U.S. District Judge Jeffery S. White declared DOMA unconstitutional when a lesbian federal court employees married partner was denied health benefits because of DOMA.

White said 'tradition alone' does not justify legislation that targets a vulnerable social group.

"The obligation of the court is to define the liberty of all, not to mandate our own moral code," White wrote. "The 'ancient lineage' of a classification does not render it legitimate."

Next stop, the Supremes.

One certainly hopes so, because it is a dumb law and deceptively named. But, lest we forget, this is the opinion of one judge in the Ninth Circuit Court, and that court's decisions are overruled by SCOTUS more than those of any other court.
