Hey, I'm all in favor of Alabama making it harder for those evil Canadians to come into our country and take our jobs (yes, Stephen, I'm talking about you!), but I am wondering about the crime noted here:
Alabama's governor on Thursday signed a tough new illegal immigration crackdown that contains provisions requiring public schools to determine students' immigration status and making it a crime to knowingly give an illegal immigrant a ride.
Full story here.

So how does this work? Is giving an illegal a ride across Alabama considered aiding and abetting a criminal, is that how they can make it into a crime? And what about buses? Or subways? What if I toss Stephen in the trunk or tie him to the hood?

Legally, that's a no-brainer. The law says it'sa crime only if you knowingly give an illegal immigrant a ride; if you're charged, just claim that you didn't know you were giving the person a ride.

no. you'd obviously know he was a Canajun, eh? What you didn't know was that you were giving him a ride.
Ah. Um, and when the officer asked you "What did you think you were doing?" your answer would be?

Hmm. What if the illegal was driving? Obviously, he'd be illegally driving, but if you're the passenger then you're not giving him a ride...are you?

Whatever you do, don't say "dancing". They frown upon that sort of thing around there.

How, exactly, is a motorist supposed to determine the immigration status of a passenger?

It does say "knowingly"--so, if you don't ask if they're legal or not legal you might be okay. If you know they're illegal however, you'd better not give 'em a ride!

And again the Obamamedia uses words that aren't in the law...this is how Reuters wrote the same piece. There is no mention of giving a person a "ride".

It also will be a crime to knowingly transport or harbor someone who is in the country illegally.

Which tracks with the Federal law already on the books.

I suppose this would go for all forms of transportation, not just cars or trucks or buses.

So, when the Canadian living next door climbs in your car, don't forget to ask him for his papers.

Ah. Um, and when the officer asked you "What did you think you were doing?" your answer would be?

perhaps you could imply that you weren't "giving him a ride" so much as "taking him for a ride" or even suggest that it's simply a matter of perception, seeing as it was the car that he was riding in, not on your back (or even front), and all you were doing was driving the car. Let's not try to be sensible in the face of such an idiotic law!

The new greeting from police in Alabama: Papers!

It has been the law from 1940, I believe, that all legal immigrants in the U.S. must carry on their person some form of proof of their immigration status and provide it when requested by legal authorities.

This is usually in the form of a Green Card even the card is now blue. For students or those here on a work visa I assume it would be a passport with the proper visa stamp.

If the Alabama follows the Arizona law the officer has to have "reasonable suspicion." The reasonable suspicion rule has been upheld by the Supreme Court of the U.S. on several occasions.

The Arizona law follows the U.S. Government law very closely although it actually make it more difficult for local law enforcement officers to ask if they simply have a feeling. Which, in my opinion, is absolutely correct.

And again the Obamamedia uses words that aren't in the law...
The "Obamamedia"? Zeb, you silly conservative! You are so ill informed. Obama doesn't run the Huffington Post. That'd be like me calling Fox News the "Palinmedia." Just because they like her doesn't mean she has anything to do with their conservative bias or what they decide to say or how they decide to say it.

Kinda unfair to blame the president for everything, but, hey, that does seem to be parr for the course with conservatives. It's all Obama's fault even if it's not his fault

Those laws are discriminatory and racist. They need to be struck down as they no longer reflect our more enlightened time. Much like the Constitution. *sarc* ;)

Sure, why not, he blames Bush for everything, not that Bush was a choirboy or a conservative...which by the way I'm not.

You can check the books if you want, but I was a resident alien for most of the 50s and I never had to carry papers. All that was required was an annual, mail-in Alien Registration Form. Wait a second! I was a real registered Alien! Now we know the truth about Roswell; the Eisenhower Administration pretended we were all Canadians!
