Justice, Genocide, or the Breaks?

The pimp got what he deserved. The girl who killed him got screwed by the court system. She shouldn't serve a life sentence for that. She should get a letter of commendation and a badge of honor.

Seems to me Sara's case was simply injust from the getgo.

Which does not surprise me. Anyone here surprised?

I agree 100%. A jury probably would have acquitted her, or given her a hung jury because of nullification. That judge sounds like a senile bigot. Maybe the Governator will cut her loose, or at least cut her a lot of slack.

In accordance with the Armistad ruling, perhaps she could have gotten acquitted on the grounds of justifiable homocide.

ETA: Here is the legal ruling on that case: http://en.wikipedia.org/wiki/Amistad_(1841)

What the hell does genocide have to do with this case?

I was wondering about that myself.

ETA: Maybe this why

"Numerous legal and medical associations are supporting Sullivan and Graham on the grounds that the courts should not judge teenagers in the same way as they judge adults, just as governments recognize the difference by placing certain restrictions on juvenile drinking, voting and marrying," the Times states.

The Alternet article on Kruzan -- who is black -- notes that race is also a factor in life sentences for juveniles.

"African American youth are serving [sentences] at a rate of about 10 times that of white youth," Alison Parker of Human Rights Watch told AlterNet. "In some states, the rate is even higher

Here in Florida we have a guy in prison for a very long time. When he was 12 he nurdered a 6 year old girl by stomping her to death; the judge gave him life in prison. Then everyone had a major pity party for the poor kid and the judge let him out of prison. Then he pulled some crap that landed him back in jail, the judge scolded him and let him go, and then he used a gun to rob a pizza guy. He's toast now. Poor dear!

Florida used to hang kids. In 1910 a 13 year old New York boy was paroled and sent to Florida. In Florida he stabbed a girl 65 times and beat her with a bicycle chain. Florida hanged his ass and the New York papers went weepy and hysterical: HE WAS JUST A CHILD!

There are some kids who are just bad seeds, and that 12 year old and the New York kid sound like examples of that. I will admit that if I knew all the circumstances I might think differently, but I probably wouldn't. However, the girl this thread is about is not one of those bad seeds.

I remember a 13 year old girl named Caril Fugate. About 50 years ago, she joined her 19 year old boyfriend, Charles Starkweather in murdering her parents and going on a killing spree in Mo and KS. The hanged him (they knew what to do back then) and she served most of her life in prison. Eventually she was released, but I haven't heard of her since.

Here Here.

"Justice must not only be done, but should be seen to be done".

I couldn't agree more. IMO her race had something to do with the sentence she received. The girl was simply railroaded.

Fromll what I have seen of the case, this was not a jury trial. Any lawyer who let this case be tried by a judge only should be disbarred. Maybe even locked up in the funny farm.

I doubt very much that a jury would have convicted her. They may not have acquitted her, but they woud have been hung.

I've seen battalions of teeny bopper killers skip into court dressed like Dorothy Gale form Kansas. Their lawyers sound like most of you. A girl named Valessa Robinson sat on Momma's chest, cutting mom's neck with a serrated knife cuz mom wouldnt let Valessa's boyfriend spend the night for sex. And old Valessa gets on the stand talking baby talk: I KNOW MY MOMMY HAS FORGIVEN ME. And I can imagine many of you thinking THATS RIGHT, THE JUDGE IS AN ASSHOLE.

Valessa got twenty years and her boy friend is on Death Row. Both of them are in the right place. The subject of this thread is another matter entirely. The girl probably should have been acquitted as having committed justifiable homocide. If she didn't have a jury trial, her lawyer was a fool, and maybe even criminally negligent.

That's based on what I've read about the case here and in other places., There may be something I don't know. :(

BOX, the legal issue is killing the guy 3 years later.

I totally agree that some scumbags need to die, and killing them is a public service. But the law doesnt let you do it when its convenient for you.

The sentence is grossly excessive. Possessing infinite wisdom I'd give the girl 5 years of rehab and close supervision, then seal her record if she performed well.

Valessa's boyfriend was a client of mine. When I picked him up we knew his dad was dead and had no idea where his momma was. She left years ago. But she popped back up when I filed a petition to terminate her parental rights. Adam was rotten to the core and had a load of criminal charges, but the judge let him go with momma, and he killed Mrs. Robinson.
