Man kills neighbor's dog, says it was justified

LINN COUNTY - A family is mourning the loss of their pet after a neighbor shot and killed their dog.
The dog, a 5-year-old Gordon Setter named Dakota, escaped from his owner's home about 4 p.m. on Friday. Marci Read, who is wheelchair bound, could not chase after Dakota.
Four hours later, a deputy knocked at Read's door and told her the dog had been shot and killed.
According to police reports, Brian Lee Powell, 48, told Linn County deputies he thought he could shoot the dog because it was on his land and he lives outside the city limits. His house is just on the outskirts of northeast Albany, in an area with several new family neighborhoods.
Powell's wife said as far as she knows, her husband shot the dog to protect their livestock --a few chickens kept behind chain link fencing.
Powell was arrested at his home and booked into the Linn County Jail on charges of aggravated animal abuse, a felony, and unlawful use of a deadly weapon.
