C'mon Phil. Libs/Dems aren't perfect but we generally absolutely mean it when we say 'I don't agree with what you say, but I'll fight for your right to say it.' We're even pretty reluctant to back people voting with their wallets even though the two aren't similar. The Right 100% stops backing your right to say something when they disagree with it and they show it time and time again. Stop pretending we can take them at face value.

Blah, blah, blah, blah. The courts have ruled that there is a difference, even SCOTUS has chimed in. Bottom line, if you aren't in cuffs on your way to the holding cell, you were detained.

The courts may have rules that way, I'm not seeing you posting examples so we can see the context. Cornell is one of the best legal schools in the country and I did post. The difference between detained and arrested isn't about cuffs or a holding cell. Its a matter of if a reasonable person would think they have the right to walk away. Most Americans do not know their rights and even those of us who do its not always advisable to exercise them. As a black man I'm sure as fuck not walking away from a police officer who hasn't very clearly vocalized that I am free to go. I'm not bulletproof and lets be 100% here. If I did walk away and get shot in the back you'd be the first person in line claiming that my 'My Little Pony' shirt identifies me as part of a gang and the officer had every reason to be terrified I was going to show up at his home with the Herd and stomp his family out. It was just self defense!
 
TIL that being put in handcuffs and prevented from moving freely in America did not infringe a person's constitutional rights. Just for exercising their constitutional rights.
