Untrue. Garcia was given TWO immigration hearings and was deemed deportable based on his MS13 membership. His deportation order was stayed by a THIRD judge who believed his sob story about rival gangs killing him if he was deported.

So he GOT his due process. He HAD his chance to contest the deportation and didn't make the grade so the judge(S) ruled against him.

The immigration hearings did not conclude he was a train gang member, and there is no evidence of any court concluding he was or ruling in trump admin favor. All this talk about Dems wanting criminals roaming free in our borders is bullshit gaslighting to distract from the real issue: that they fucked up and don’t want to fix it because on one level it’s another test case on pushing the boundaries of executive power by defying SCOTUS and ignoring the constitution. trump will create a true constitutional crisis any moment.

In fact, an anonymous source claimed Garcia was a gang member (maybe the dude hated Garcia) and the officer who put the accusation in his report was later fired for misconduct in office, basically, corruption. So extremely thin “evidence” and a questionable officer involved.

Moreover, Garcia had a judges order saying he couldn’t be deported until certain things happened, like a return to court and due process. So he did NOT get the due process he deserved. And he wasn’t the only one rounded up via very, very dubious evidence. One was a pro soccer layer who had a tattoo of Real Madrid logo, but hey, it had a crown or cross or something so he must be a gang member

He HAD his trial. TWICE. The other illegal migrants who have been arrested also get their shot at contesting the deportation orders at an immigration hearing.

Interesting thing I read today about that; Covid hit right about that time and every nations borders were closed. Since it would violate the law against prolonged detention while waiting for removal, Trump's 1st term Administration had no choice except to release Garcia. That sounds like obeying the law to me instead of disobeying it.

Garcia at that point had an obligation to remove himself on his own dime to any place which would accept him or be faced with being deported by the government to anywhere they could send him. He chose not to do that for 5 years, which is a dereliction of his obligation to avoid being deported to El Salvador.

The administration picked him up again and whisked him away to CECOT, admittedly in violation of the court's imposed stay against his deportation to El Salvador. The administration admitted it made a mistake when it did this.

That mistake cannot be remedied.

Garcia is in his home country, subject to that country's laws. The US cannot just "retrieve" him because that would be a violation of El Salvadoran sovereignty and an Act Of War. So the US must "ask" (ie facilitate) El Salvador to return him to the US. El Salvador has refused to extradite its citizen to the US for the purpose of allowing the US to punish Garcia by immediately removing him to a place other than his home country. Since no nation will accept him, the ONLY available option is to send Garcia to GITMO where he will be placed in solitary confinement for the rest of his life with no possibility of release.

Yet THAT is exactly what the D's want to happen. Which sounds a LOT like the D's prefer cruel and unusual punishments. Which would be par for the course considering what the D party has become.

There's no immunity from impeachment and removal from office.

Boasberg's not naming Trump. (see above) He is going after those who should have known better than to do what Trump asked.
