Because he is leaving the day President Biden is leaving office, the Vacancies Reform Act specifically prohibits Trump's favorite gambit, naming someone as "acting" for an indefinite period. You can't arbitrarily name an FBI director UNLESS he/she is 1) confirmed by the Senate OR 2 ) an existing department employee at a GS-15 pay grade AND 90 days already employed by an agency.
Since Donald has named fellow grifter Kashyap Pramod Vinod Patel as his choice for FBI director, he MUST undergo an up or down vote in the United States Senate before he can mismanage the Bureau.
This will put US Senators "on record" when Patel screws the pooch, as he is usually inclined to do.
Wray's "first assistant" Paul Abbate, who has been the deputy director of the F.B.I. since 2021, would legally be the interim FBI director until Kashyap Pramod Vinod Patel is confirmed.
