Whenever discussions about punctuation come up, I am reminded of a lesson I had to give my grandson years ago.

He had brought home a composition written for his 8th grade English class and was complaining about it being marked down for a poor use of punctuation; in particular, commas..

"I don't see what the big deal is," he complained.

I downloaded the Jim Stafford song, "My Girl Bill" and let him listen to it.

He never questioned the importance of proper punctuation again.

I'm not an expert on UK copyright law, but I located this via a quick online search. Section 30(1) of the Act (https://www.legislation.gov.uk/ukpga/1988/48) provides in relevant part:

(1) Fair dealing with a work for the purpose of criticism or review, of that or another work or of a performance of a work, does not infringe any copyright in the work provided that it is accompanied by a sufficient acknowledgement (unless this would be impossible for reasons of practicality or otherwise)] [and provided that the work has been made available to the public].

(1ZA) Copyright in a work is not infringed by the use of a quotation from the work (whether for criticism or review or otherwise) provided that—

(a) the work has been made available to the public,

(b) the use of the quotation is fair dealing with the work,

(c) the extent of the quotation is no more than is required by the specific purpose for which it is used, and

(d) the quotation is accompanied by a sufficient acknowledgement (unless this would be impossible for reasons of practicality or otherwise).


I haven't read any of the applicable UK case law, but it would appear to me that his quotation satisfies these requirements. The work was released to the public for sale. He quoted sparingly from it. He did so for the purpose of commentary. His quotation is no more than is necessary for his purpose in highlighting its amusing and useful nature. He provided a sufficient acknowledgment. There is no possible theory of damage or injury. I would think that any sane copyright owner would be grateful to see her work advertised in this way so as to promote its sales.
You've put the cart before the horse. The precondition is that it must be '(b) ... fair dealing with the work' and that's a matter for the court to decide.

Imagine a comic published a book of his jokes and someone quoted all his best jokes; would that be fair dealing? This is a humorous work about punctuation marks. The OP has quoted all the copyright holder's best jokes to illustrate an appropriate usage of most punctuation marks. Fair dealing? If the copyright holder chose to enforce their copyright. There is a theory of damages. The copyright holder doesn't have to prove special damage at law, they would be entitled to general damages for infringement of their right even in the absence of an account for profits (something different to special damages).

As usual, you confuse policing with the law. You'll have heard the stories about burglary having been decriminalised in San Francisco. Ask the OP what would happen if he was burgled when he was out and he phoned the police to report it. They'd ask him who did it, if he said he didn't know, he'd be given a crime number to pass to his house insurers and no further action would be taken. That happens in 80%+ cases of burglary, people claim that burglary has been effectively decriminalised but that doesn't as a matter of law make burglary legal. Similarly with copyright infringement, the want of enforcement action against low level infringements doesn't mean it's not infringement.

And copyright holders often assert copyright but decline to enforce it when it's brought to their intention. I expect you, like everyone else has made videos where music was being played in the background the uploaded them to YouTube. The video plays out to the copyrighted number. In due course, you receive a notice of infringement from YouTube but saying you need take no action. The copyright holder is happy, he gets the benefit of a free promotional video at no cost.

Want of enforcement action will not make an unlawful act legal. You've confused that issue before. Lack of expertise perhaps?
