Good. It's about time. Like Starfish asked, nationally?
 
Its about freaking time. Thta is one of my biggest pet peeves while driving. I can not count the number of times I have almost gotten into an accident because someone was to busy talking on the phone to pay attention.
 
Here in New York State, as of November 1st, Police will pull you over and issue you a warning if you are using a handheld cellular or digital phone while operating a motor vehicle. As of December 1st, they will ticket you. I haven't read anything about the fine schedule, and any of the "hands free" headsets are still perfectly lawful for drivers to use while they're behind the wheel.

Just my two bits' worth.... (I know, it used to be two cents, but inflation and all.....)
 
In order to increase public awareness of the new cell phone restrictions, the law includes a warning period and a waiver provision as follows:
  • Between November 1 and November 30, law enforcement personnel may stop motor vehicles and issue verbal warnings to motorists driving while using a hand-held cell phone.
  • Between December 1 and March 1, 2002, the courts may waive fines if the motorist is able to supply the court with proof that he or she has purchased a hands free telephone or a device that enables a hand held telephone to be operated hands free. This waiver provision only applies to a first offense.

This law would set fines of up to $50 for a first infraction, $100 for number two and $200 for a third. You are, however, allowed a 60-second grace period to pull over and talk.

if it's illegal over here but it damn well should be.

Happily, you could be prosecuted for not having proper control,or
failing to pay due care and attention.

It has been advocated that any use of a phone,even hands free
should be banned.

Kay, then we have to ban smoking, tuning the radio, changing a tape or the channel and eating while driving as well. :rolleyes:

The reason for the hands free is that many people are required to work out of their cars all day long and they NEED the phone.
