Until Inauguration Day in January there could be a change of candidates.

Last week I thought of this scenario?

rump gets the MAGApublican nomination and wins. Then sentencing for his felonies puts him in real jail, not house arrest. Does he get sworn in wearing five points and an orange jumpsuit?

To me the best solution for this scenario would be to turn the White House into a jail. By this I mean in the paperwork sense, it's already pretty "secure". The SS would be tasked with ensuring the Presidents safety as well as the security of his movement from leaving the White House.

Sticking him in a regular prison would just create too many issues, which could be easily overcome if the "White House" became a "jail" for his time in office.

Part of incarceration is isolation. In your vision of WH=jail would rump be allowed to function as POTUS while his legal affairs are dealt with in the court system?

To me, visitation and access to outside conveniences should be curtailed. Make up a broom closet as a cell. No business actitivities that an inmate in Rikers or a Federal prison is allowed.

I agree, but hypothetically speaking, Trump wins the election, and second is actually sentenced to a term in prison. In this one, Trump wins first, then is sentenced second, he then appeals, is sworn in, in Jan. He can be the President, because nothing in the qualifications for office says you can't hold office if you are convicted.

Assuming he then loses his appeal and has to report to jail. Since he is President, and he still has to function in that capacity, it would seem the best place logistically would be to hold him in the White House.

I agree it's not the most palatable idea, but can you imagine a foreign head of state visiting the President in a penitentiary? Or holding Security Briefings....its an endless list of difficulties.

But is that possible? He would be the President, with all the powers and duties of that office.
 
Trump is already being treated so specially that I don't think he'd be incarcerated anywhere if the Electoral College gives him a win in November. (He can't get there on a "every voter is equal" popular vote.) I can wait to see how this will spin out.

Of the current conviction, he'll not have a jail sentence. Unless he violates his gag order. Then I can see him getting 10 days.

It seems that a felon shouldn’t be allowed to work another job while doing time

Yep, I agree, and I think SCOTUS would be the decider on this matter in the end. Would they disqualify him? Would they over rule the sentence? Would they stay the date of incarceration? Would they hold off deciding until the clock runs out on his four year term? Any way you slice it, it would be a shit show!!

The equivalency in this case isn't hard to see. Cohen got three years for the exact same activity that Trump orchestrated, paid for, and was the one who benefited from.

What direct intervention can the U.S. Supreme Court make into a state-law and prosecuted conviction and sentencing? They'd have to approach this through the state laws vs. federal law that set the prosecution into motion.

I don't know the answer, I just surmise it would end up there.
