Not to spoil the whole offbeat point of this thread, but I was thinking about this today . . . if USA-PATRIOT is so unconstitutional, why hasn't the Supreme Court struck it down?

Because the wheels of justice turn slow. The lawsuits in the lower courts to get it thrown out haven't happened yet. Once they do, they'll fight all the way up there.
