1 of 4 things can happen here.

1. Sullivan can deny the motion. The case then proceeds to sentencing, Flynn appeals and the appeals court reverses and vacates with an order to the lower court to dismiss the case.

2. The special magistrate can recommend anything and Sullivan will go along with it. If that results in contempt charges, Flynn will appeal, the appeals court will reverse and vacate with an order to dismiss the entire case.
