KK is a D-bag but technically, rulings by one Circuit Court do not have to be followed by other circuits so this ruling only applies to Massachusetts, Rhode Island, Maine, New Hampshire and Puerto Rico. Only Supreme Court rulings on constitutionality must be followed by every circuit.
