Maybe both? They don't list an author and they changed one word...lovers to erotica to fit their site...it's kind of chintzy, only 10 stories or else they're brand new. I don't even see a webmaster...
 
I'm sorry this happened to you Cookie. I know how it fels to have your work stolen and no one should have to go through it. I hope you can get them to take it down if you aren't happy with it being there or at least give you proper credit for writing it if you aren't.

Thanks Colly...the thing I hate the most is their switching words to fit their needs. At least no one else claimed it was theirs...

I went through the process of copyrighting my short stories after my first one was pirated. It was expensive, but at least now I can just contact my lawyer whenever I see one of my works somewhere I don't want it or didn't authorize it to be and she can deal with getting it removed.

For anyone who dosen't know you can group all your stories together that you posted in one year as an anthology of your work and get them copyrighted in one shot for the same price as you would pay for any single work. It sure makes it less daunting moneywise to go ahead and get a copyright.

I was under the impression that you didn't have to do anything to copyright stories you've written.

It is my understanding that you don't have to do anything anymore. A work is yours and you have the copyright as soon as you pen it, paint it, sculpt it etc. However, when it comes to proving it in a situation where two people claim authorship you are only protected if you can prove it is your work. What level of proof you need probably varries as widely as the situation where you find yourself. Being a very non confrontational person I feel a lot better with the copyright taken care of and a lawyer to speak for me should another work be pirated.

If someone steals a story from Lit and posts it on their website, it would just be a matter of checking the time logs, wouldn't it?

The story that became public at 1.15pm is probably the original one, whereas the one posted at 4.20pm the same day probably is the fake.

This story was posted in Feb. 2003 for the Valentine's contest...

That would seem logical, but you are in essence telling a webmaster at one site he must remove a presumably popular story and the basis of you proof is another website featuring erotic stories. Some of them don't want to hear it. Thats what I ran into at least.

The question of copyright infringement is complex, Colleen is quite right to have a lawyer deal with infringement cases.

I have posted this link before and do so again as it contains useful information about Copyright, Moral Rights, Intellectual Property Rights and the Fair Dealing principle that stems from the Berne Convention on copyright.

In a nutshell, it would be difficult to obtain damages for Cookie from the people who stole her story because it:
1 Came from a free site - no commercial loss
2 It is posted on a free site - no commercial gain

If it could be proved that Lit. were in the process of changing to a pay site and rewarding its authors for stories posted then a case for damages could be constructed.

Cookie could force the site to remove the story, the cost may not be worth it, may be better, if possible, to contact the publishers and ask them to credit the story or even provide a link back to Lit.

Although the site deals with Uk aspects of the law, it is pretty much international advice, there are small variations from country to country that do not change the essential structure of the law.

There isn't much I can do...there isn't even a place to e-mail them.

It gets stranger...the site says...

It says these are stories of lesbian encounters. Mine is clearly a man and a woman. They spelled lesbian, stories, and also wrong.

This is the cheesiest site I have seen so far...


It isn't my day...I just got feedback to write more incest stories. Lol...I haven't written one and don't plan on it.
 
If I were you I'd go to bed and start agin tomorrow. :D

Try pasting a copyright logo on your next story, that might make them think twice, some other Lit. authors do that.

It's an allright day as long as you can keep smiling about it :) It only becomes a bad day when you can't laugh any more.

According to Whois.net and Verizon, the domain is registered to Global Internet Consulting Group, LLC out of Palm Springs, CA.

Fascinating.
 
Poor man's copyright: print story and mail it to yourself but don't open it. Then you have a sealed, postal dated copy of the work that will predate any other claims.


That website sounds as if it's run by an ESL webmaster.

Directnic's Who Is function is good for finding out who owns a domain. There has to be a contact listed for them in order to register the site. If you can't reach them through that info, you contact whoever holds the domain registration for them. That causes lovely problems for the non-responsive jerks.

Under the Digital Rights Millennium something or other, you can sue the hell out of people for copyright infringement. I mean if RIAA can sue little twelve year old girls for 4 grand, webowners who post your work are liable as well. And don' t think the site is free just because they don't charge membership dues. They are making money from advertisements and the spyware they put on people's computers. They are in business.

Point being, they don't want to be sued. I haven't heard of a case yet where once you got someone to respond, they didn't remove your story.

Me? I don't worry about it. It's too much fucking hassle. Now if I were charging money for my stories and they were putting food on the table; it would be another matter.
