Song Legality Question

And it stirs my ulcer because folks here scream bloody murder when their stories are stolen and slapped on another Web site, but they don't think twice about stealing all or portions of works by others and slapping them on this Web site.

I have seen a similar double standard around here - reverence for the sanctity of their own stories, but a complete lack of concern for the copyright owners of music getting pirated off the internet. (Not aimed at any particular poster, just a general trend.) Being a songwriter/musician myself, it's not a laughing matter. (Steps off of soapbox and slinks into the darkness, humming 'All You Need Is Love' by the Beatles.)

Not worth living, of course. But that is irrelvant to what I've posted. What I've tried to counter here is clueless folks telling other clueless folks there's either no risk or that the risk is something other than what it is.

How is quoting a pop song "stealing" it? If I quote "All you need is love" I can be sure that nearly everyone who reads my story will know that's a quote, and who it came from.

That recognition factor is the reason amateur writers use song lyrics. We want the artist's name to become part of the zietgiest of the story.

If I find my story on the internet with someone else's name attached to it, I can be pretty sure that the readers will never know it was stolen, or from whom.

That obscurity is the reason fic thieves steal amateur fiction. They want to get credit for writing something really good. If credit for writing something good is all I get-- I'll fight for every bit of it.

If I find my story on the internet with my name attached, I can be sure that the site owners are attaching my name to things I don't want to be a part of, and my content is adding to their site's profitability.

True. But I think Stella was taking issue with the comparison of using song lyrics--usually though not always used in stories with credit to the creator (aka: "All you need is love..." the Beatles sang from the Radio....), as being the same as stealing a story off Lit.

This doesn't mean that we can't be sued for quoting song lyrics, just that the two aren't necessarily equal and we shouldn't be taken to task on doing to others what we don't like being done to us.

And although one worsen one's case by not giving credit when republishing the lyrics to a song on a Web site like this (or in stories posted here), that doesn't change one's copyright infringement culpability for republishing them without permission one iota. (And again, the justice of that can be debated until we're blue in the face, but the law is the law is the law.)

So, I'm not really sure what your point is.

No, I'm saying there's a whole lot of copyrighted material being posted to these forums (including extensive song lyrics, not incidentally) in larger portion than copyright permits.

And, no, the passage you quoted from me wasn't composed with a thought to being limited to song lyrics (and I'm sure that Starrkers, who it was addressed to, understood perfectly that I was talking about broader copyright infringement)--although there is, in fact, a continuing thread on this forum of extensive copyrighted song lyrics being reposted without permission. So, I'm not sure why you have a burr under your saddle about this.

Song lyrics are copyright. Generally it is accepted you may use two lines of them verbatim without permission BUT if the owner of the copyright is of a mind to, and sees the usage, they are well within their rights to sue. And they will win.

We may argue black is blue over it, but the same copyright that protects us, protects lyricists. Using their work, any of their work, without permission is a breach; regardless of our intention.

Lyrics use.

I use song lyrics quite often. I go by the standards set by Literotica. (which is 50% or less) I do make sure that I gave the name of the singer or songwriter credit. I have even asked for permission to use a poem lyric one time but didn't get it. I just wrote myown poem.

Most times when using a song, I have a couple request a song and dance to it with one of them siging along. Maybe a couple putting on a record or DVD and list the first couple of lines to the song. If I'm ever asked to remove a story because of a song I would do so.

I've never encountered a problem and either has Jake and the other authors of stories. We do at least two songs a year and write about them. In fact we are doing one right now about a country song.

I did 'You Gave Me A Mountain' by writing a story about what the person in the song went through in his life. With 'El Paso' we all told our version of what the song meant. Same with 'Bed of Roses' and 'You don't know me'. As I said, in all cases we gave credit to the writer or singer of the songs. There were more but those were a few examples.

I was talking about copyright infringement, which is the same under law for song lyrics, prose, forum postings, story submissions, images reposted in the body of postings or as avatars without permission (interesting where this goes, eh?), etc. Copyright infringement. I was talking about the principle of copyright infringement.

Getting a little dense around here? Ostriches up the line in your lienage, perhaps? Running obtuseness into the ground maybe? Litte strange, as Starrkers noted, that writers wouldn't "get it." Ah, but we're not all writers here, are we? Some just came to chat in the presence of writers. :)

Perhaps not. But then my posts have all been in relationship to what folks don't seem to want to latch into what I posted. You've been dinking on and obfuscating about what I posted. If I've not responded to whatever else you are discussing, it's because you weren't saying anything I was interested in discussing (although I know you to be a fascinating person and often I just shine in the light of what you have to say) beyond trying to twist or be obtuse about what I posted.

So perhaps the two ships passing in the night can just keep on passing. That would be hunky dorey with me. :)

I am interested in why people do what they do, think what they think, and rationalise their actions. My 'obfuscations' have been in relation to that interest. I already know the legal issues of copyright. I'm interested in why people do and don't observe the laws, where they feel it's sacred ground and where they feel they have a right to infringe. Forums are, to the people who use them, conversations. You see them as publishing, but good luck with convincing the userbase.

But in the times that I know of where someone has objected-- I've had a run in with Warner Brothers in my past-- the request is simply to delete the posts, because, the convention is that these are ephemeral data.

It's possible that some record company might try to grab punitive damages, but I have a feeling the defence will argue customary use and get away with it.

I could tell you were filtering everything I'd said according to your own presuppositions. That's why I posted a more specific and carefully spelled out version.
