That's a very good question. Can hotmail or yahoo be held accountable for pornographic attachments uploaded to their servers?

In my brief moments as an adult webmistress, that has always been my worry. I look at LJ and people are posting all kinds of shit. hen they get caught, they're suspended, but what if teh feds catch them first?

The forum is a 'service' which the provider (laurel, manu) do not and reasonably cannot 'manage' the content of.

Who the fuck wrote this essentially unenforceable law; it's in black and white that it excludes any 'self-loading' sites.

I wanna see how the Republican judges get around this piece of stupidity; if you're going to write a prohibitive law, fucking do it right.

Actually, this cannot legally apply to the Lit Forum.

It's in black and white; if it applies to the forum then it applies to cell-phone companies who allow picture takers to send picture to other cell-phone users on their network. It's the exact same service; Literotica only provides the service and because it's a 'self-loading one' (i.e. the user loads the picture) Literotica cannot reasonably manage the sexually explicit content.

To enforce it on Literotica (and I'm sure they will try) means the cell-phone companies can be taken down by the same law if even one user 'distributes' a sexually explicit image through his cell-phone.

This law is horribly written; it's a shotgun meant to be used against specific things... I hope they Republicans have enough of the judges in their back-pockets because this thing is crap.

Well so you can’t show your vibrating penis or a woman shaking her legs as she feels her man or paid lover depositing his “baby gravy” lol! I love that term. Anyway this does in no way affect the written word which is more powerful than any picture.
In my mind it really makes no difference at all to Lit, we create visual images through words that can blow the mind much more effectively than any picture.

Yeah, ES, but remember, whoever they bring this law against is still going to have to pay to defend themselves. They can make things very expensive.

The government takes a position, and suddenly the money people - the credit card companies, the banks and investors - get cold feet and start withrdrawing from the market rather than risk a courst challenge and all that hassle. They don't have to make it illegal to stifle it.

No legal challenge, no day in court, nothing noble about free speech. They just scare these guys in their wallets and they pack up and run screaming.

Ok, I can understand that they're careful and forbidding the other categories, but why would they formid this one? I'm not into this stuff, but I just find it weird to include this category. Heck, if it hadn't been for the fact the email was from a BDSM site, I would imagine the site forbidding BDSM stories/drawings too!

You hit the nail on the head Doc. It isn't designed to be enforceable. it's designed to be a club rathe than a scalpal. the US AG has an unlimited budget and nothing better to do with his time. He gets his check no matter what litigation is befor the court and he can afford to draw it out forever.

In this case, the threat of it is more useful to the progrom than the actual use.
