HERCULES (CBS 5) – An East Bay dad claims a game of tag on the playground resulted in his 6-year-old son being accused of sexual assault – a decision he said was an overreaction by school officials.

The parent, who asked only to be identified as Oswin, said his son was accused of brushing his best friend’s leg or groin while the two were playing on the playground at Lupine Hills Elementary in Hercules two months ago.

Oswin said his child was kept in the principal’s office for two hours until he confessed. He was suspended, and a sexual battery charge was placed on his permanent school record.

It was a six year old playing tag...running around trying to tag his friend...the friend was trying to keep from being tagged. What other kind of description do you need? Or have you never played tag?

I would say "Sometimes the law is an ass" but this time, it was not the law, because there is no such law. It was just an idiotically overzealous principal, :(
probably on a power trip.
 
Stupid stuff like this is what concerns me about my kids in school. My boy is in second grade and my daughter will be in kindergarten next year. And do I worry about stuff like teachers, resources, etc? Yeah, but not as much as I do about stuff like this.
 
Ask yourselves why policis like this exists. There is a reason, believe me. I'm not saying it's stupid or it's not stupid-I'm saying something happened in the past that resulted in policies like this.

I'll give you an example from my school. About five years ago we were called to a staff meeting after car rider line was over. We were told in no uncertain terms we were not allowed to help children snap, button, belt-whatever-the kids clothes. I taught K (age 5/6). There were always girls in cute little dresses and boys in jeans that had that stupid snap or damn button. Some wore belts.

If they couldn't undo them, we were not allowed to help. Period. If reported, we were wrote up. Get wrote up enough and that's your ass. If that meant a kid went all day with his jeans undone, then that's what happened. We *were* allowed to ask the nurse to help them as long as there was two witnesses. And that's when we could find her. She attended our school, the middle and the high.

Not to mention I'm supposed to be teaching, not running around the school. Again, spending too much out of the class can get you wrote up.

What brought this on? Yup. Fear of being sued for 'touching a child' by helping snap his jeans. The teachers ended up sending a note to parents telling them of the new rule and to dress their child in something they could get in and out of because we weren't allowed to help.

And, of course, another shit storm got started. Btw, the rule is still enforced.

This is just one rule of many I could talk about that makes you wonder what the hell. Something always prompted a new rule. How's this: the girls could only play with girls and the boys only play with boys. There was a reason that was passed at my school.

Tell the truth, I'm glad this time next year my youngest will be graduating.

Thanks to some life crap and a long bout of depression, had a year-long+ case of writer block flu set in. :(

BUT....if you haven't already noticed....I managed to get back into pounding the fingers and tacked seven new chapters on the no-end-in-sight, Kyle & Josh love story in the past month; and even started a shorty too. :)

Dear Parent,
Either you give written permission to adjust your child's dress or dress them in something they can get into/ out of themselves.
We cannot be doing with this cult of suing over our heads. We have enough to do teaching your child the basics of life and learning without having to worry about getting a black mark because we acted in loco parentis.

I agree. Although the incident at hand seems to just be one of the natural hazards of a carefree game of tag, there is definitely a good cause to be mindful of kids touching other kids' genitals during play.

I have heard a case where two young friends were roughhousing one day and one of the boys kept grabbing the other's privates. The authorities eventually got involved and it turned out that the 'grabber' boy was being abused and had been brainwashed by his abuser into thinking that playing with another person's genitals was perfectly normal. So in certain circumstances, this behavior can be a red flag.

No doubt, in this day and age, school officials believe that they might be found culpable if they hear of such warning signs and neglect to pursue them.

However, I'd like to say that perhaps the overreaction in this game of tag lies not just with the school officials, but also with the kids involved. Because I find it unlikely that a teacher was standing there, watching the game and paying close attention to which body regions each and every "tag" was being made upon.

More than likely, the kid whose groin was accidentally touched reported the incident to the teacher himself - probably because he'd been told repeatedly that touching someone on the doodle is the most evil thing a person can do, and if it ever happens to him, he should tell everybody he can find, so that the person who did it can be sent to jail for the rest of their lives, where they belong. The subtleties of the issue - such as accidental contact, or legitimate reasons, such as a teacher helping them get their pants off so they can use the bathroom - were never properly hashed out for the poor kid.

If that's the case, then once the "victim" child reported it, the principal's hand was more or less forced. He couldn't be the one who did nothing about a report of "sexual assault". Especially if the tattling kid took the matter to his parents and they decided to make a fuss. Ignoring the issue would risk ending his career.
