Seeking writer for a Disney NSFW parody game

I am creating a NSFW Disney parody virtual novel game and I am looking for a writer to replace one who recently quit. You must be able to:

-- Work as a team with another writer and an editor
-- Write erotic dialog and scene descriptions
-- Write passages that connect pre-defined story beats at my direction
-- Come up with new ideas for character arcs
-- Establish characters' personalities through your writing
-- Have a general familiarity with Disney characters and the ability to rewatch movies for reference
-- Commit to this as a long-term project
--Work for revenue share

If all of this sounds good to you, reply to this thread or send me a message. Please include a link to your work. I'll provide you with any additional information you need, as well as a link to the first released version of the game.

Have you fully analyzed all the copyright issues? Do you have a legal opinion about them?

The extent of the "sexual parody" fair use defense to copyright infringement is, from what I understand, murky and unsettled. And it appears that your project is a commercial project, which would weigh against fair use and be more likely to attract the attention of Disney's lawyers, who are known to be super zealous in matters of copyright.

A potential partner probably would want to have a better feel for the legal footing on this issue before getting involved.
 
I can't be 100% sure when it comes to legal questions, but there are several reasons why I am not concerned about this, which include:

-- This is hardly the first game to parody Disney characters. None of those larger, more popular, and more financially successful ones have been targeted.
-- The game is in fact releasing for free. The Patreon money goes to "supporting the developer", which may seem like a small distinction, but manages to skirt more legal issues.
-- I could also name a few parody art websites which DO charge for access to the work itself, which have not been targeted.
-- As you say, fair use seems to be determined on a case-by-case basis, but considers things like how effective the parody is. We DO strive to comment on and make fun of the original work in our game's dialog, which is again more than some of my above examples do.
-- It is also notoriously hard to prove that a NSFW parody actually takes away business or profit from the original work - i.e., that someone is playing my game INSTEAD OF supporting Disney, rather than in addition to.
-- Worst case scenario (based on examples of games that have been targeted and cancelled...not by The Mouse, but by Nintendo, for example) is we get a C&D, and then we stop. They can't take further legal action, like trying to sue, unless we ignore that.

So yes, I've done my research, and furthermore, the way everything is set up currently, I am the only one who has put in a real name anywhere and could be gone after.
 
Disney is famous for protecting their brand. There was a small family owned day care near here that Disney sued for paintings of their characters on the walls. The day carer almost closed due to legal costs.

The day care filed for bankruptcy and was able to stay in business. WB gave them permission to use Looney tunes characters at no charge.

Many Disney characters predate Disney by centuries. If you only parodize the original content (not anything specifically added by Disney themselves) you are on safe ground.
 
Okay, first, as far as I know, it's completely doable if you use characters not originally created by Disney. For instance, you can do Beauty and the Beast as the original story was written by French novelist Gabrielle-Suzanne Barbot de Villeneuve back in 1740.

Where it becomes troublesome is when you use Disney's visual depictions of Beauty and the Beast. THAT is copyright infringement.

Sadly, when everyone else will get involved is because this is to be "erotic" correct? If you bring in some characters like the Little Mermaid who was 13 in the story by Hans Christian Andersen (1837). Disney made her 16, as an emancipated young woman can get legally married in most states with her parents permission. However Disney didn't show the wedding night. Regardless if you say "this happens when The Little Mermaid is over 18," legal law in the US state that any fictional character who is depicted as under 18, is perpetually that age, regardless of any statement otherwise.

Then, as soon as you use the name "Ariel" for The Little Mermaid, is when Disney's law department comes after you, too.

You can delay legal proceedings if the website is hosted in a country without extradition rights to the US. This should also stop the other country from offering up your name (if you reside in the US). However, then you'd have to still abide by the laws of the other country.

True... you are a curmudgeon. heh heh I suppose they could have posted this in the Literotica Personals, but creative writers sought after to finish writing a story hang out here, and looking for a writer to (finish) write a story is a purpose of this section.

What I'm curious about is if the original writer is going to get any of the proceeds for the work they did?

In most cases, writers (like artists) get paid a flat sum of money up front (or part now, part on completion). They don't usually get "revenue shares" as if the whole thing goes belly up, then they get nothing for all of their efforts. Otherwise, presumably, funds received for the whole shebang go to one person, who then distributes the funds accordingly. That's a WHOLE LOT of trust that everything is transparent and being done on the straight and narrow.
 
Alright! Well, I think they've learned that their approach needs to be a little different & address certain issues...assuming they're being honest about the purpose.
