DEMOCRATS WIN DEBATE --- FREEDOM LOSES
The debate over the so-called “Patient’s Bill of Rights” will continue this week in the Senate. My guess? The Democratic Socialists will win and liberty will lose. As one Democrat spokesman said over the weekend, “How can Bush afford to veto anything called The Patient’s Bill of Rights?”

This spokesman hit the nail on the head. It’s all in the name. It’s all in the title. He knows, as so many other Democrats and Republicans do, that the dumb masses in this country will not look one word further than the title. No extra reading, no investigation, no questions … nothing. The title is good enough for them, as the politicians pushing it knew it would be. The mental debate of the average American goes only so far. Everybody knows that anything called a “Bill of Rights” must be good. This thing is called a “Bill of Rights,” therefore, it must be OK. End of thought process.

So, what is the goal of this bill? Admittedly, the goal is to address some of the problems that have arisen in our move to HMOs, PPOs and other types of managed care. The socialists in government, though, have hijacked this bill and added provisions that are aimed at just one goal – creating chaos in the delivery of medical care.

Since the 1950s the singular goal of the Democrat Party in this country insofar as health care is concerned has been to establish some form of socialized medicine in the United States. Every single piece of legislation supported or proposed by Democrats for decades has moved us ever nearer to a full-fledged system of government managed health care.

Have Americans completely forgotten the ill-fated HillaryCare proposal of 1993? This proposal would have placed an additional 17 percent of our gross domestic product (our economy, for those of you with Camaros) under the direct control of the Imperial Federal Government. If you’ve forgotten that hideous piece of Democrat legislation, here’s a gentle reminder. Under HillaryCare if you decided to find a doctor to provide you with medical care outside of the government plan, and you took the money that you worked for and you earned and used that money to pay that doctor for his medical services, both you and your “private” doctor would have committed a crime and would be subject to criminal prosecution. Can you imagine that? Finding a licensed doctor to administer legal medical care, and paying that doctor for his services, would be a crime!!!

Oh, but it sounds so good, doesn’t it! Boortz says that this bill is going to create some degree of chaos. Boortz says that this bill will cause private employers to drop their insurance programs. Boortz says that health insurance costs, and premiums will increase! Don’t listen to the radio blowhard! He doesn’t know what he’s talking about!

To be sure, the Democrats assure us that there are “safe harbor” provisions in the act that will protect employers from medical malpractice lawsuits. Well, that’s just great, isn’t it! We’ll just take their word for it. They say that employers won’t get sued, that’s good enough for me!

But I seem to remember similar assurances from the leftists with another piece of legislation called the Americans with Disabilities Act. They told us that this bill wouldn’t lead to idiotic lawsuits too, didn’t they? They promised us that there were all sorts of protections built in the ADA for employers who made a good faith effort to comply with the law. And what do we end up with? Well, a school system in Florida can’t fire a superintendent with multiple shoplifting convictions because his thievery is the result of a disability. A trucking company can’t fire a driver with one eye. That’s discrimination. A strip club in California is cited because a stripper uses a portable shower stall in her act on stage – because the shower stall isn’t handicapped accessible.

Then there was the Clean Water Act. Hey! Who could argue with this? Wassamattau? You against clean water or something? Some right wing “reactionaries” said that the wetlands provisions in this bill would infringe on the rights of private landowners. “No way!” said the leftist enviro-radicals. We are assured that the bill is very plain – that the wetland provisions can only apply to waters “appurtenant to the navigable waterways of the United States.” So --- the Clean Water Act passes. What happens? The U.S. Army Corps of Engineers gets the nod for enforcing the wetlands provisions, the “Glancing Geese” doctrine is established, and homeowner are cited and fined for putting fill dirt in low-lying spots in their back yards --- many miles away from an “navigable waterway.”

Now these same alarmists right wing reactionaries who warned the country about the ADA and the Clean Water Act are sounding the alarm of the Patient’s Bill of Rights. Again, the left says “No way!” “That will never happen!” “The legislation forbids it!”

So, this time we’re going to believe them? This time we’re going to take them at their word? Isn’t that the definition of insanity? You know, doing the same thing time after time again and always expecting a different result? The left has placed that football on the kicking tee again --- and here comes right-wing Charlie Brown just ready to kick the dog squeeze out of it. If you’ve been reading the cartoon strip for any time at all you know just what is going to happen.

As Brit Hume said on Fox News Sunday yesterday …. “Why in the world would you put a provision in this bill allowing people to sue their employers? What is the thinking process behind that?”

Brit Hume knows what the thinking process is. Again – to create chaos. The Democrats absolutely want employers to drop their health insurance coverage. They want hundreds of thousands, even millions of additional Americans to become “uninsured!” And when they do become uninsured they want to make it as tough as they can for these people to go out there and buy their own health insurance policies. That’s why Democrats defeated an amendment to the Patient’s Bill of Rights making privately purchased health insurance policies tax deductible. Once these people are cut loose from their employer-provided health insurance, the leftists want them to flounder about with no real affordable options. Then – then they’ll demand a solution from --- guess who? --- GOVERNMENT!

It’s all so simple. Create the problem, then present yourself as the solution. It’s a game the left plays so well, and a game the right seems unable to defend against.

scrap it come up with something better. I think we all should quite slapping on legislative bandages that will only need to be re-legislated when evryone finally stops playing politics and sees the thing through and goes, oh oh one more time when a whole new group of victims will starting shouting about getting screwed.

But when I saw how upset it made lavender and CH, I had to read it.

The "TONE" of the article could grate on the nerves, but the content is EXCELLENT. I kept looking for something I could disagree with to prove what a reasonable person I am, but it WAS NOT there.

The Clean Water Act was a good idea, but in implememtation, it SUCKS!!!!!

On some land I have in north Louisiana, I have a few ponds that were built by my grandfather. They are MAN-MADE. Several years ago, the dam broke on one of the ponds, draining it almost completely dry. Since it is almost impossible to rebuild a dam, I tried to hire a contractor to take a dozer and remove the whole dam. The contractor had to get a permit from the parish. The parish refused to issue a permit because the Clean Water Act does not permit an existing "wetland" to be destroyed. The parish told me that they were supposed to "force" me to rebuild the dam, but if I didn't touch it, they wouldn't say anything. So now I have a federally protected mud hole.

The ADA is a good idea, but the way it has been interpreted SUCKS!!!!!

A good friend of mine, has a little carry-out bakery within a mile of my house. She wanted to put two little tables in the front so people could have a cup of coffee and talk with her while they wait. In compliance with the ADA, local inspectors demanded that she install two handicapped equiped restrooms for her "restaurant". Price??? $5,000. STUPID!!!!!

I have already posted why I think the "Patient's Bill of Rights" is a HORRIBLE idea. It is Ted Kennedy's brain child, as were HMO's to start with. If they would take out the lawyer's ability to sue the employer, I would stop complaining about the bill. But just like I posted last week, that is the ONE provision that the Democrats REALLY want. That is the SINGLE provision that will cause employers to stop providing medical insurance for employees. That is the ONE provision that will eventually cause private funding of the medical system to CRASH, and REQUIRE government to step in and nationalize healthcare.

I can't really speak with expertise in regards to the clean water act....and some of the other points...but I CAN in regards to the ADA....

My son has a rare form of Autism with some physcosis called Asbergers syndrome...without the ADA...my son would not be able to keep a job...for yrs....my son would lose jobs because of his disability....his disabilty is obvious and makes people uncomfortable...His medication has dramatic side affects as well.My son is smart....but not very mature...I personally have encouraged him to try to work...rather than live on SSI...I was overjoyed when the ADA was passed...he finally had some work protections availabe,Prior...anytime some ugly person saw his symptoms..and complained...he would be dropped,Of course there are some people that abuse the law in regards to the ADA..but the law states that an employer only needs to give a reasonable accomadation so he may work...despite his disabiltity,it also states that he or his gaurdian must request it through normal channels.Overall it is a good law...I susspose we just need to define more specifically what constitutes a disabilty..and we must have a medical board that represents all types of Legal Docs and Physciatrist...so it may be done correctly.


Mt tone toward Todd is because he never really seems to look at the world as it truly is,an ugly mean and unfair world.Very few things can be interprited in black and white as he insist on doing.

Texan...you are a polite man...and a fellow Texan...so I can deal with you...You have kids and have lived...so you may have a good point or two...hell we all do at times...but if Todd really wants to learn as he says he does,,,then he needs to accept that none has a monopoly on truth...NONE

at least I understand some why you lash at me and I do feel for your plight, but this is not the world of Hobbes and it is really better than all that. Your son will find his path, I hope you find peace.

It could be worse, have I have pointed out, I have been visiting with a mother watching her toddler die, slowly, inexoribly...

I enjoyed reading your very reasonable reply. I hope you noted that I began my criticism of the ADA with a comment that it was a good idea. I am glad it provides good things for a lot of people.

I believe that a lot of the problems of MANY laws are in the implementation of the laws. Remember, the bill that congress passes is just the tip of the iceberg. When a law passes congress, some governmental department is then tasked with creating all the regulations necessary to inforce the law. It is in the regulations (details) that the stupidity of most laws can be found.

In the case of the ADA, the Department of Justice was tasked with creating the regulations and inforcing the law. They delegated large portions of implementation to different governmental departments. (HUD, Commerce, Education) The regulations that are associated with the law change with each administration. Under a Democratic administration, many regulations will be inacted that would be immediately changed under a Republican administration. When citizens don't like one or more regulations, they go to court to challenge the regulation.

ADA is implemented under three "Titles"
Title I: Employment practices by units of State and local government,
Title II: Programs, services and activities of State and local government, and
Title III: Public accommodations and commercial facilities (private businesses and non-profit service providers).

Do you notice that there is nothing in the implementation that refers to the "federal government"? They are exempt from the ADA.

Right now, the Department of Justice is suing AMC theatres and United Artists under Title III, because their seating arrangements do not offer "prime" locations for wheelchairs, and the isles slope too much for some wheel chair victims.

The Department of Justice has recently filed in injunction to attempt to force "self-service" gas stations to offer assistance to handicapped customers. They want SELF-SERVICE gas stations to pump the gas for handicapped customers, at the self-service price.

Did you realize that the Department of Justice has just gained the authority (Clinton's last week in office) to approve and certify all state and local building codes. Talk about a federal power grab from states and local governments.

Laws passed by congress MUST be written in a way that CONTROLLS the bureaucracy that is the federal government. Bureaucracy is like a virus.... it grows uncontrollably if left on its own.

So, because the thing is called the Patient "Bill of Rights" Dubya doesn't dare veto the thing? Come on, if its a bad piece of legislation the NAME of it shouldn't scare a competent, intelligent leader who isn't afraid to make the right decision even if its the tough decision. Oh, right, Dubya. My goof for expection so much from the guy.

If I heard correctly, employers can only be sued under this thing if they actually provide medical advice to their workers that turns out to be faulty. For example--while you're working a light fixture falls and brains you good. Woozy and bleeding, your employer recommends you take some aspirin and then go see a vet about that cut on your head, vets being cheaper than human doctors. Turns out you have a concussion and need to have the swelling in your brain reduced by having holes drilled in your head. You would be allowed to sue your employer. For good reason, too.

Now, how often do employers give medical advice? I dunno, but I'll be you see lots of factory jobs where someone gets hurt and the foreman says, "It's no big deal, get back to work". In that case the worker should have the right to sue the employer. If it's something like, "Hey, I have a tummyache", and the employer says, "Um, I have some Tums, want one?" and it turns out the guy has a peptic ulcer and he ends up dying of peritonitis, then the employer should be in the clear.

why employers need to pay anything other than a salary or wage.

Todd you just insulted my GF and one of my best friends at work. Ughhhh. Couldn't you at least partialy edit your C and P jobs so they resemble something an intelligent and tolerant human would write.

Crystal my GF has had similar problems with finding jobs. She is severly hearing impaired. She has no hearing in her left ear and about 40% in her right. She is looking for summer jobs now, since her summer internship is unpaid. Alot of the places she has applied to are giving her the run around because of her disability. She could make a big deal about it but I don't think she is going to. They are just summer jobs and she does not like to call attention to her disability if she can avoid it. People are cruel. There is no other way around it. Sure the ADA has caused some problems but almost any large bit of legislation has instances of abuse. The benifts far outway the costs.

Now Todd being a christian and all aren't you supposed to love people and such. Whats up with this posting things that call people "enviro leftist wackos" or whatever. Whatever happend to the tolerance aspect of Christianity. Oh and while I am on the tolerance subject I have a question. Why are the two most bigoted people i work with the most religious. They are both young men, under 21, who go to a Baptist Bible college near where i work. Any time a Black guy comes in guess what are the first words out of their mouths when they see him? They normally say something like, "Oh damn her comes another ni***r." This one Mexican guy that comes into the shop owns a medium sized lawn care and landscaping business. He has two or three trucks that we service. Care to guess on what they say when he or some of his employess come around? "Well look its a truck crammed full of Mexicans. Damn I bet there backs are still wet from crossing the river. Look at them all pile out of the truck its like a circus." I have asked them about this and the usually reply with, "What do you mean tolerance? I tolerate them, but I can still make fun of them all I want." Isn't there something in Christian dogma that a sinful act is just as bad as a sinful thought or something like that.

Anyway I am rambling. I just find it funny that at least in my area and in my own experiences the most closed minded and least tolerant people are the hard core christians. Maybe it is just my area, but i still find it disgusting. It is one of the reasons I dont go to church anymore and don't practice a regular religon. Most of them are too hypocritical. I am not saying I don't belive in some supreme being or some kind of higher power because I do. I am just saying that I doubt any religion that has been established and overseen by ordinary humans could really express "God" as it was intended. If he was so powerful and mighty how could a mere human hope to understand and quantify him.

You answered your own question, Baptist which , ugh, I attend seem to have the education and mindset of superiority, I noticed it the 3 years i went to college. I really noticed it from the profesors cause even though I look quite caucasion I am a human mutt, mixed breed, and the professors knew that from looking over the student records. and the Professors really dug into that fact and tryied to use it to deter me.

Bigotry is what I call the baptist flaw. Took me 2 years to deprogram myself before I would talk to anyone outside my skin color or heritage when i first became a xtian.
