Expect a nominee, but no vote. They want to leave the seat open to drive turnout (and has been thoroughly proven, conservatives are WAY more motivated to vote based on judicial nominations than liberals are). Even if/when Trump loses, they can fill the seat in a lame duck session.

If they were to pull such a stunt, the Democrats do have some cards to play in 2021, if they get a Senate majority. The main one is that having nine justices can be changed at any time.

This is one of those statements that looks more profound than it really is, since Court vacancies rarely occur in election years, for obvious reasons. And it's obviously a transparent attempt by McConnell to claim that his double standard really isn't because the circumstances are completely different.

The last time a Justice left voluntarily in an election year was when Chief Justice Earl Warren announced his retirement in the summer of 1968, because he was worried about being replaced by Nixon (then way ahead in the polls, though the eventual vote ended up being pretty close). The Senate had a Democratic majority, but there were enough Republicans and Dixiecrats to filibuster the nomination of his replacement ... on the grounds that it was up to the new president to make the choice.

I'm not sure if there's precedent for a justice dying less than 50 days prior to an election, but I'm fairly certain the Senate has never acted on a nomination made this close to an election. If Scalia had died in September instead of February, I doubt Obama would have bothered with a nomination.

Mitch has to have a majority to use that. And so far at least 4 Republican Sneators have said they will not vote on a confirmation of a Supreme court justice until after the election. Puts Mitch a bit short of the necessary votes it does.

Additionally, you do realize that Mitch has been using that in a limited way all along and after what else he's pulled over the last 4 years that come January, if the Senate is Democratically controlled the "nuclear option" will be used not just for confirmation of judges but will be SOP for everything, don't you? I can hear the whining already.

I'd say McConnell has to sink a bit more before he gets down to the level of the opposition.

I don't care what side you are on there is something wrong with Biden's Health. He looks awful, his speech is sometimes slurred and he has to talk with his head down to read. Sad. Of course he isn't orange so who knows.:confused:

Watch a Trump appearance from the 2016 campaign, and then contrast it to how he sounded at his speech for Constitution Day on Thursday. He sounded like a man emerging from anesthesia.

Did you even watch the Kavanaugh confirmation hearings???

The only thing manufactured were Kavanaugh's bullshit responses and explanations for his yearbook entries and his overall behavior in high school and college.

There are now two credibly accused sexual assaulters on the Supreme Court and one credibly accused sexual assaulter currently serving as president.

1. Probably the same thing the Democrats are doing; screaming as loudly as they can and pointing meaningless fingers while watching powerlessly from the sidelines.

2. Shut the hell up so I can get some sleep without worrying that yet another American city is going to go up in flames because of a collective childish temper tantrum on steroids.
