Question for the lawyers of Lit

Hello all. I have a question for those legal beagles here at Lit. I recently won an auction on Ebay for a sports card that was graded by an independant grading service, and therefore carries a significant premium over one that is not. I was the high bidder on the item (it ended up being $24.00) and paid for it via paypal. When the item arrived, it was not only NOT graded as described (the picture shows the graded version, as well as a serial # assigned to it by the authenticator,) in fact, it wasn't graded at all, and it was damaged to boot. When I went to Ebay about it, they said that because it was less than $25, they would not be anble to help me. I tried E-mailing the person who held the auction, but he swears he not only didn't run a graded auction (which he clearly did, I printed it out for whatever recourse I may have,) but that he sent a graded card, all the while being very negative towards me in his response. I saved his envelope also, because a graded card wouldn't even fit in the envelope. My question is, what recourse do I have, and where do I go. Obviously, I was ripped off, and there was fraud involving the postoffice, internet, and who knows what else...I just want my money back. What do I do??? Thanks for taking the time to read this.

Contact paypal about the issue. Be sure to send them EVERY detail about the transaction. Link to the page with the auction, emails between you and ebay and you and the person EVERYTHING.

PayPal is VERY good about dealing with these issues and getting your money back.

You have to fight with eBay to do jack about anything.
