Question about Amazon KDP

I recently started selling a couple of things on Amazon. Today I get an e-mail from them saying that because the material of one of my books is "freely" available in many places on the internet they will no longer sell it.

I do have the same book for sale on Smashwords and am confused as except for the KDP select program (which I am not enrolled in) I did not think that they could tell you that you cannot sell it anywhere else.

The bigger problem is that this story was at one time on lit. So when I started searching I of course found it on several sites. Now let's face it, there is no way in hell I am going to be able to get this pulled off of these sites, I mean hell they stole it in the first place so are there any options here?
 
DMCA notice to the sites, and if you've registered the story with the Copyright Office sending them a copy of the registration.
 
Amazon is a for profit company. They can do pretty much what they want to do. They have a huge number of books for sale already. Why would they want to list a book that's available elsewhere, probably for free?
I sell in Amazon and also in Smashwords. What I publish in Amazon, I don't publish in Smashwords and vice versa.
Amazon is a lot more picky about what they publish, than is Smashwords. You might keep that in mind when you decide where to publish. JMHO.

As far as SW goes, my understanding was that unless you were in the select program you can sell the book elsewhere so I don;t think that's the problem, its where it ended up after I put it up on the grocery shelf of Lit for mass consumption.
