Man Arrested After Appearing Naked In Own Home

MASSILLON, Ohio -- A man appearing naked in his own home was arrested Monday, Massillon police said.

The 43-year-old man was charged with two counts of public indecency.

Officers arrested the Charles Avenue S.E. resident when he was observed naked in an open window.
 
There have been many cases like this throughout the US and most end the same...

The court or DA throws the case out as the man or woman has the right to do whatever he/she wants in the privacy of their own home. Just because you can see into someones home doesn't mean they are wrong for what they do there.

You don't like what you see, stop looking.

Of course I would have those peeping toms arrested for violating my privacy.

Being in the public view can change things depending on the laws of a given municipality.

I know that one of the reasons so many of the communities here in Virginia Beach have the oversized privacy fences is that the police can, and have, arrested people for drinking in their own back yards when the people have been intoxicated and open containers were seen in hand.

That's a little different than me walking in my house neked. But if it was the backyard, how did the police see them? Where the police trespassing in order to spy/peep on these individuals? Did the police trespass on neighbors prorpery? So many questions and not enough time.
 
I know of one guy in my previous neighbourhood who was reported to the police for exposing himself naked and masturbating in the window whenever there were teenage girls outside. Apparently he was trying to impress them by showing what they were missing... :rolleyes:

After a few more incidents with the law, the man hastily left the country.
 
I was in this little town some time back.. I asked one of the locals if they had a night club.

He replied, "Nope. We do got a widder' don't pull her shades all the way down, though."

The solution is really very simple. Arrest the guy. Take him down to a Magistrate and make public charges that the guy was observed naked in front of an open window. Then, pass a [supposed] photo of the guy to the Magistrate. The Magistrate examines the photo carefully and then asks, "Is this an actual front view photo of the defendant nude in front of the window?" Answer, "Yes." Magistrate, "Release the defendant, insufficient evidence!"

See if the guy subjects himself to that again.
 
Ok, now did he do that intentionally? I mean, who here hasn't walked around neked in their house at least once... what if he just forgot the curtain? :p

With the rocketing crime rates, we're out arresting men in their own homes for nudity :p
 
What about women walking around naked in their homes? Should I start to worry? Should I put on a robe? Turn off the lights?

I'm using a satitlite feed from one of the DOD's spy sats, so whoever is on the third floor is some kinda creep! :eek:

Sadly this is not only becoming a bit more common, it is also becoming more intrusive.

I remember a case several years ago where a younger couple were arrested and charged for public obscenity on Cape Cod.

Their venue? Their enclosed back yard. More specificly their hot tub in their fully enclosed back yard.

It seems one of their neighbors had become suspicouse of their activities after they built the fence, (A 13 foot stockade fence,) around their yard. He had waited for a time when both were away from home, then leaning a ladder against the fence climbed up and mounted a small video camera, (the kind sold in stores for surveilance.) on the top of a fence post making sure it was pointing at and had a clear view of the Hot Tub.

He ran the wires back to his house and attached them to his V.C.R. He then watched and waited. Over the next several weeks he and his wife recorded several hours worth of footage clearly showing this couples blatant disregard for societies morals as they lolled about their Hot Tub in the buff.

All of this was, shall we say exposed, in the trial after the neighbor turned the video tapes over to the local D.A. The couple were duly arrested and had their day in court.

It surprised some that this case even made it to court. The case should have been thrown out because the couple were nude only in their backyard which was surrounded by the 13 foot tall fence. The neighbor should have been prosecuted for trespass because he placed the camera on their property right? Not according to the Courts at that time. He was not trespassing because the foot of the ladder was on his property, and he never actually did touch their property. He just placed two items of his on it. As for the public indescnecy charges? They ended up being found guilty and paying several thousand dollars in fines because the courts had proof that they had indeed been outside of their house. (It seems it didn't matter how the footage was gotten.)

The couple in question then closed their bussiness and moved. The house was sold. Their employees, all sixty plus of them had to find other jobs. (As a side note, one of their employees happened to be the daughter of the neighbors.)

Oh the neighbors happened to be very powerful in the local church.

And no one brought a civil rights suit against them. By placing that camera on my fence to look down in my yard, which I assume to be private because of the 13ft fence I placed around it, is a violation of my right to privacy.

The jerk wad that put up that camera should have been hauled up in federal court and sent to Leveaworth or some other federal prison that's not a country club for the rich and famous.
