Possible plagiarism..Here's my evidence

Someone stole my story from here and submitted it under a different name. BoomLikeThat is listed as the author. I've tried to get them to remove the story and have gotten no response whatsoever. And it's not even erotica.

Forgive me, sr71plt, for stirring up this one again (I know you're fed up with it :))...

... but it used to be that the links on AskJolene for my stories came straight back here to Lit. But it seems that as of 2 January 2009 (or thereabouts), my stories are now actually on that site.

Now I have no real cause to complain I suppose, because at least the stories have my name on them and thus far, there are no other stories listed under my name that I haven't written. Interestingly enough, the stories I've written under a different alt still link back to Lit.

But should I be bothered about this? I get that once I post something on the net, I effectively lose control of it anyway. I just don't quite see what AskJolene get out of this.

How much luck have people here had in getting their stories removed from AskJolene, anyway?

Just wonderin'.

Hello.

I am not an author, but I found a site that *might* be stealing stories from here--however I've been unable to confirm it. Let me tell you what I found and you can make your own judgments.

I was browsing the AskJolene site when I saw a story that began "This is exclusive to Literotica.com, if found elsewhere please notify FallingToFly.." I pulled up the list of "author's stories" here and at AskJolene, and at a quick glance they look identical:

.

THANK YOU!

I put that disclaimer up in hopes that people would let me know when my stories and links to my stories appeared in odd places. Thank you SOOOOOO MUCH for following through and letting the Lit crowd know.:kiss::kiss:

ETA: Yep, they have my stories ON their site... As well as a bunch of stuff I DIDN'T write, so I assume there's someone else on another story site with the same username. They have two stories from my Alt, StormRising, that link back to Literotica on on side (the search side) but are ON THE SITE if I do the long way around and search through their story archive. Which means they copy pasted them from Lit to there.

*grumblecussgrowl* I'd really like my stories off of there. I checked, and my XXX site blocker didn't catch it, which means kids could get on there- *sigh* Annoying, annoying, annoying.

Thanks for the heads up. They actually have my one story posted 4 years ago under my old nick! I did send them a cease and desist request. Mine had someone else's name on it, though. I do not know if it does any good, but I am tempted to sign up over there and wreak some total havoc.

In all this time, no-one has ever jacked it as far as I can tell. But sometimes my GoogleFu is not as good as I would like.

I just posted comments on all of mine pointing anyone reading them there back to Lit ( though many already do that in the author's notes anyhow )

They only horked portions of mine, and the formatting is horrible on that site.

I registered with the site forum under my old Lit Username... So I can post stories (like I am going to.), and post on the forums (if they do not remove it, I will.). I have not figured out how to track down the person who submitted it, because there is no PM system in place. It is a very rudimentary forum.

So far all the stories listed as mine are actually mine, so I'm just going along and posting a comment on eachh of them directing readers to my website <shrugs> as long as they credit me I don't care.

That's not a bad idea, actually. Might just do that, and maybe add a note to explain that I didn't post them there and that actually, they've been 'stolen' from Lit, LOL.

Thanks :)

They have about 12 of the stories I posted here under my old username. C&P, not linked.

I have sent them cease and desist, tried to otherwise contact the site owners, made a note on each story that I wished them taken down and they were posted without permission and stolen from Lit...

Nothing.

Pisses me off no end.

They've reposted 211 of mine. Am I going to bother to try to do anything to get them off? No. They were posted for free read to begin with, and this is just further dissemination of the stories.

I'm pretty sure they still have stories listed under my name that aren't actually mine, and I've tried without success to get them to stop that. I don't care about them displaying my stories under my name all that much, but the fact that they make me look like a plagiarist bothers me to no end.

I suspected as much. Oh well...

That's kind of how I'm trying to look at it. Believe me, I'm grateful that as yet, they're all my stories. Like you, fieryjen, I'd be seriously pissed off if it looked like I was plagiarising.

But it's not looking as though there's much we can do about it anyway, sigh.

Is it possible that someone else has the same pen name as you? Maybe they're on a different site. When you click on the link does it bring you back to Lit?

These are the practical steps you could take:

1. First, and foremost, don't post anything you want to maintain control over on an open Internet site.

2. Ask them to stop (and/or get Lit. to ask them to stop). That seems to have worked a charm. (not)

3. File for formal copyright for your stories so that you at least have some sort of legal position (at $35 a pop, but you can put stories together in anthologies for blanket coverge).

4. Then ask them to stop posting, citing you hold formal copyright and will sue. (This might work on occasion).

5. Hire a lawyer in the country where the Internet site originates and hope for the best.

If you aren't prepared to go through these steps, you are just whistling up the chimney in putting a lot of angst into the effort (and the offending Web site knows this).

And then, even if this works on one Web site, there will be another one to contend with from step one when you turn around.

Awesome news!

Nope, it's something. They have every one of my stories on there, under my Nom de Plume. :)

Here's a page that will give you the AskJolene site registration info and an e-mail address. They're registered out of the Netherlands.

Thank you so much for the link to the Who Is site and the text of your letter. I did not plaigarize it completely, but... Last night I sent them:

Hello,

My research indicates that you are the owner of askjolene.com.

My story "Welcome to London" was posted on Literotica.com on 1-8-2005 in the Group Sex section. Here is the link. http://www.literotica.com/stories/showstory.php?id=179129 .

Someone has stolen my story, placed their name on it and posted it on your site on 2-9-2009. Here is the link: http://stories.askjolene.com/73325/Fiction/Welcome+to+London!

I am the sole owner and writer of the story, and the copyright is mine under international law. Literotica is the only website with permission to post it. It has been stolen and reprinted verbatim on your site without permission. I require that you immediately remove it, pending legal action.

Thank you for your prompt attention to this matter.

Purple Tiara

I heard back from an admin, and they pulled the stories and banned the user entirely!

I just double checked, and it has been removed and the scurvy knave, er thief has been banned. All of their work has been removed which makes sense as I scanned some of "their" stories last night. They were harvesting from a lot of sources. I found several stories from here and one from the old Satin Slippers site.

I immediately sent the gentleman who responded a thank you email. I also warned him that he might get a tsunami because there are a lot of stories from Lit over there. I have gone through this before, and I was expecting a long kerfluffle with maybe a 50/50 chance of success. I was really pleased that they were so cool.

Even though I am still going to check them periodically anyway, just in case.

Thanks very much, PurpleTiara. :) I also sent an email to the site admin. They've removed my stories, banned the person who posted them and offered their apologies.

Against all odds, it worked... Maybe I just got lucky. :D
