Its my custom to start my day reading the news.

I read about stupid OJ and stupid Brittney, about the war about missing children but this frosted my ass.

Dry cleaner in pants suit closes

WASHINGTON - The owners of a dry cleaner who were sued for $54 million over a missing pair of pants have closed and sold the shop involved in the dispute, their attorney said Wednesday.


The South Korean immigrants are citing a loss of revenue and the emotional strain of defending the lawsuit. They will focus their energy on another dry-cleaning shop they still own, said their attorney, Chris Manning.

"This is a truly tragic example of how devastating frivolous litigation can be to the American people and to small businesses," Manning said in a statement.

Soo Chung and her husband, Jin Nam Chung, faced more than two years of litigation after a former customer at Custom Cleaners alleged they had lost a pair of his pants, then sued for $67 million under the District of Columbia's strict consumer protection act.

Plaintiff Roy L. Pearson, a local administrative law judge, later lowered his demand to $54 million. He said the "Satisfaction Guaranteed" and "Same Day Service" signs that once hung in the shop were misleading and fraudulent.

The case went to trial in June and a D.C. Superior Court judge ruled in favor of the Chungs, awarding Pearson nothing. Pearson is pursuing an appeal.

The Chungs incurred more than $100,000 in legal expenses, which were eventually paid with help from fundraisers and donations.

Even after the trial ended favorably, Manning said, the Chungs lost customers and revenue. They have now closed two of their three businesses since the lawsuit began, he said.

Pearson did not respond to an e-mail from The Associated Press seeking comment.


All over a pair of fucking pants!!! Pants for Christ's sake! Pants the bastard couldn't wash or fix himself....$54 MILLION....for pants!!! and now these people are losing their livelyhood.

I think this judge and his frivilous lawsuit needs to be taken to the cleaners as well. I think he should have to work in a hospital laundry for a few months....and then forced to wear itchy burlap pants.

Indeed. Unfortunately it's the tip of the iceberg, if you will, regarding ridiculous lawsuits and verdicts.

A lawyer, who can't manage his own affairs, uses his legal training to lash out at a couple of hard working people who are just trying to earn a living. The lawyer has now driven the people out of two of three businesses they once owned.

It appears that the lawyer will lose his $105K+ a year job and that seems reasonable. However, where is the bar association? The bar association is supposed to oversee the professional conduct of its members. If the bar association thinks a $50+ million dollar lawsuit over a lost pair of pants is reasonable professional conduct, then the bar association needs to be put out of business. JMNTHO.
 
I expect that there will be a return lawsuit at some point, for harassment.

Hasn't the guy just lost his job because of this?
 
It's times like this that I wish there was a Smack in the Face law. I'm not sure what the particulars of it would be, but it would allow the shop owners to smack this guy in the face until he runs away, without fear of repercussions.
 
This judge got exactly what he was after. He knew there was no way these people could pay so much money, he only sought to punish them for his inconvenience. My father's business was sued for about $10,000 by a former employee who claimed he hurt himself at work a couple of years earlier (by doing something against the rules). It would have cost more than $10,000 to fight it, so my dad decided to pay (legalized blackmail). Aggressive people can easily manipulate the system, it's why I hate personal injury lawyers so much. Without turning the thread political, I think anyone who trusts the good intentions of these scumbags is deluded.

Apparently, the The D.C. Inspector General is doing a harsh review of the Office of Administrative Hearings, where Fancy Pants was employed (and about to be fired from). Maybe the bar ass. wants to see how that pans out before taking steps?

Would you believe that my sister-in-law the attorney was sued by a client. The state of Ohio had hired her to represent him on his appeal. He was dead guilty and the judge rejected the appeal. So the client, sitting in jail and having nothing better to do started suing people, including my sister-in-law.

Even though it was complete bullshit she had to shell out a thousand dollar deductable for her 'lawyer insurance' as she calls it, to defend herself and to add insult to injury the state of Ohio hadn't paid her for the original case yet.

I think people need to find better things to do. Can we sue them for being stupid? (Just kidding!!)

Reading about it I saw this:

My heart went out to the poor man as I thought of the taxpayers money being spent to keep this courtroom air-conditioned, cleaned, the judge and bailiffs pay and other sundry items.

Personally, I think the judge who agreed to hear the case should be sentenced to the death penalty.

The problem is that the IG can [perhaps?] fire Fancy Pants and that is well and good. However, the firing of FP then turns a very dangerous whako loose on the street. FP is a trained attorney and can inflict himself on the next person who fails to satisfy his every whim. The bar association needs to address the problem of one of their own wreaking havoc on the community irregardless of what the IG does.
