NANUET, N.Y. - A 290-pound New York man is steaming mad at the White Castle fast-food chain, which he claims repeatedly broke promises to make the booths in his local eatery bigger.

Martin Kessman, 64, filed a lawsuit against the fast-food giant last week in Manhattan federal court, claiming that the uncomfortable booths violate the civil rights of fat people.

Kessman's lawsuit came more than two years after he complained to White Castle about the size of the booths at the Nanuet, N.Y., eatery and reportedly received a pledge that renovations would be carried out to cater for larger customers.

"They sent me specs and everything, about how the booths were going to be enlarged and made comfortable for people with a little more weight. So two and a half years went by, and nothing was done," he told the NY Post , adding that he has no problem finding a place to take a load off at other fast-food places and fits easily into airline seats.

The Americans with Disabilities Act is "applicable -- not only to me, but to pregnant women and to handicapped people," according to Kessman, who is suing for bigger chairs and unspecified damages. "I just want to sit down like a normal person."

Because, they would argue, a private citizen should be able to sue if they are wronged, and the government has no right to regulate seat sizes.

So here's a private citizen suing, like they advocate, and they are up in arms about it.

Begs the question of why isn't he going to those other fast food restaurants instead. Although, you'd think that if any place would be accommodating to "persons of girth" it would be a fast food restaurant.
 
I'm a bit baffled by this whole thing. The story doesn't mention how tall the guy is, only that he's 64 years old and weighs 290. If he's 6-foot-6 he probably won't fit in the booth and he probably wouldn't be considered fat.
Take of look at some of this football players who weigh 290 and you'll understand what I'm talking about.

See, as a conservative I detest the ADA, know that it has resulted in higher numbers of disabled being unemployed, and has led to God knows how many frivolous lawsuits.

I realize you aren't one of the deep thinker Lit Conservatives, but what is it you find offensive about the story? That he is exercising his Constitutional right to have his grievance addressed by the courts? Perhaps you think the government should regulate who can file a lawsuit?

What you should find interesting that no court has found that being fat is violation of the act. You are jumping to the ending without enjoying the middle of the story.

And futher - who decides what lawsuits are frivolous? You, the government or a judge? You see, a true conservative would let the judge decide. Since you don't get to be dictator, I assume you would like your big government to regulate who can file a suit, and for what.

Heh. I am 6'2", 230lbs. Those fast food places make me feel like I am sitting on a training potty. My knees come up pretty high. No problem because of my weight though, just kind of feel like I am a giant at times. Or like I am sitting at the kiddie table. I have no problem with it. Kind of funny actually.
