Early Saturday morning, MSNBC legal analyst Danny Cevallos suggested Donald Trump walked into a trap with his refusal to appear and testify at his second impeachment trial which starts next Tuesday.

Speaking with hosts Kendis Gibson and Lindsey Reiser, the defense attorney stated that House impeachment manager, Rep. Jamie Raskin (R-MD) executed "constitutional jiu-jitsu" by asking the former president to appear as opposed to subpoenaing him.

"How much could Trump's absence, actually, hurt him, in this case next week?" the attorney was asked.

"Jamie Raskin is using a great bit of constitutional jujitsu here," Cevallos replied. "They did not issue a subpoena, they just requested or invited him to come testify and President Trump declined. This is not a subpoena situation, but, you know, in our parallel-judicial courts, we have a principle: in criminal cases only that the prosecution and the judge cannot comment on an accused's silence at a criminal trial. But in civil cases, that comment or that inference, that negative inference from a defendant's silence, is allowed."

"Beyond that, the president or former president isn't even being compelled to come speak or testify at this impeachment," he continued. "And the reality is, whereas in judicial court, we have centuries of case law and bound volumes of books like the ones behind me telling today's courts what to do, the Senate is bound by none of that. They are bound by whatever the head count is of their votes in today's Senate."

On April 3, Chairman Neal asked the IRS to provide Trump’s personal tax returns and the tax returns of several of his business entities. As the debate unfolds over whether Congress has the authority to obtain the president’s tax returns, it’s worth considering two outcomes of Teapot Dome: (1) Congress has the authority to obtain the president’s tax returns and (2) Congress can compel testimony from hostile witnesses.

Chairman Neal’s request for Trump’s taxes came after the president’s ex-lawyer Michael Cohen testified before Congress on February 27 that as a businessman, Trump allegedly inflated the value of assets to apply for bank loans and deflated the same assets to avoid paying taxes.

WASHINGTON — The impeachment trial of former President Donald Trump begins this week, returning the recently departed leader to the limelight.

As in his first impeachment trial a year ago, it will be difficult for Democrats to muster the two-thirds Senate majority required to convict him. But the trial is still expected to absorb the nation's attention.

The case rests on a single charge approved by the Democratic-led House, with the support of 10 Republicans: that Trump incited the deadly Jan. 6 attack on the U.S. Capitol.

Even though Trump was defeated for re-election last year, the stakes of the trial are high for the country and for a Republican Party that is tethered to him as long as he remains popular among its core voters and has the option to run for president again.

As of Sunday evening, the structure of the trial and possible witnesses hadn't yet been announced.

Trump adviser warns he could be in serious jeopardy if criminally charged: 'No one wants to work with him'

On CNN Tuesday, correspondent Jim Acosta reported that former President Donald Trump's advisers are horrified by the legal defense put up at the impeachment trial — and believe Trump would be in serious trouble if he ever faced a criminal charge.

"It was brutal," said Acosta. "I talked to part of the former president's team and Castor's presentation and how it was incoherent at times, and this adviser was candid about it and essentially said part of the problem for the former president is that he was just having difficult difficulty assembling a high-powered legal team. His first legal team essentially bailed on him about a week ago and this one had to swoop in."

"In the words of this adviser of the former president, Trump could be in real jeopardy if he ever ends up in a criminal court proceeding," said Acosta. "According to this adviser, and this adviser said, quote, 'Trump is F'd if anyone ever charges him. No one wants to work with him.' That's how the adviser described this situation that we saw unfold at the Capitol with the former president's impeachment team offering their presentations."

Even Fox News' Sean Hannity criticized Trump's impeachment opener


Fox News host Sean Hannity, an informal adviser to former President Donald Trump, fumbled when speaking with impeachment lawyer David Schoen as he assessed the trial opener.

"I love your arguments, I loved your passion," Hannity said to Schoen. "I thought it started a little meandering. It — it was sort of like — a lot of free-associating in the beginning."

The beginning featured lawyer Bruce Castor, who was not supposed to speak at Tuesday's opener but felt he needed to after Democrats showed the 13-minute video detailing the attack.

"WTF?" said Hannity, but politely.

Palm Beach officials mull evicting Trump from Mar-a-Lago as his second impeachment trial begins

While some of the town council members have argued that Trump should abide by the terms of the agreement, others insist there is no reason why he cannot live there.

"It seems there is nothing … that would prohibit him from living in the owner's suite," Palm Beach Town Council President Margaret A. Zeidman said during the virtual meeting, according to the Sun-Sentinel.

Zeidman's remarks come just one month after Palm Beach attorney John C. Randolph also argued that Trump could legally live at Mar-a-lago as he referred to the golf community's living quarters for employees, according to People magazine.

"Pointing to the town's zoning code, which Randolph said allows that "a private club may provide living quarters for bona fide employees only," he said that an employee of a private club is defined as "any person generally working on site for the establishment ... and includes sole proprietors [and other owners]."
