We didn't release POWs until after WWII was over, of which we held 425,000 here in the U.S alone, not counting those we held overseas, none of them were entitled to legal rights in civil courts. All were held by the CinC. The British didn't release their POWs until three years after the war was over. We need to hold them for the duration of the war.
