Books with infidelity or characters that have multiple partners tend to fall in the “literary” category or they may fit into another sub genre - something like SFF, horror, or mystery.
The hero can have sex with someone other than the heroine BEFORE he meets her, but after that - only her - not matter what. The same rules apply to the heroine.
The NY houses are slowly letting M/M/F into the mix, but that has to be an exclusive HEA for all three. (now, I’m sure there are a few exceptions, but this is the basic rule)
That is the traditional definition of “Romance” and what the romance publishers are looking for and marketing… it's what sells in mainstream romance. If you go to the publishers submissions pages or read the industry guides, it is very clear that they are looking for HEA… most will not even consider HFN endings yet.
Many of the ebubs have the same rules for erotic romance… However, Ellora’s Cave just added a line called Exotika for those non-HEA stories. They are actively seeking submissions. I believe St. Martins Press is acepting non-HEA erotica as well for a print line.
