I wrote a story in which I used a movie title. In the next chapter, which has yet to be posted, I want to mention an actors name and have some dialog from the movie in the background.

My question is; Does this involve any copyrite infringement?

I another story that I am working on, two of the characters are musicians and they share the love of a particular album. They discuss a couple of songs and play some others.

Do I need permission or can I make at statement at the start or end of the story stating that is is copyrighted material with specific dates or something.

I've written two stories using song titles (actually three, but only two of them were inspired by a song.)

I only used part of the lyrics of the song in one story, but credit was given to the artist who performed the song.

You might want to see if you can PM MistressLynn. She's written a few stories based on songs. Although if she sees this thread, she may pop in here and answer your question.

I'm not sure of the copyright issues, but since you're not making money off the story, I don't think it should be a problem.
 
If you are doing this in the U.S. market:

You can cite song and movie titles and character names without copyright problem.

You can quote up to two lines of a song without problem and up to 50 words of play dialogue without problem.

If you are quoting from it in a critique way, you are safer in quoting more of it.

This (the amount of wordage you can quote) is by "what's considered safe" convention. Law doesn't give you "rights" to quote any of it.

Although doing it for profit would make it more likely you might be sued, quoting it for nonprofit doesn't protect you from anything--and using it for erotica (thus out of intended context and possibly in an objectionable way) actually heightens the risk of suit.

But no one is likely to sue in reality.

I planned to full credit to the original artist. I did quote some song lyrics once and just something about "a cool and obscure song," that got posted.

Good point about my not making a profit off the story. I just didn't want to get up in rewrite delays.

If you are posting it here, the "no profit" doesn't apply. The Web site profits from its content, so a story posted on this Web site is legally "for profit," even though it's not the story author who is profiting (and also even though the profit is minimal).

Good to know. I thought back it is only two lines of a song that I planned to use. The rest is mostly reference, meaning they refer to an album title, artist etc.
