Prosecutors allege that Mr. May on one occasion altered the mine's ventilation while an inspector was taking air samples. On another, Mr. May allegedly ordered that a monitor be rewired so that a mining machine could operate despite elevated levels of explosive methane, prosecutors said.
The charges filed Wednesday carry a potential penalty of as many as five years in prison, according to prosecutors.
The federal Mine Safety and Health Administration concluded in December, after a 20-month investigation, that the accident was "entirely preventable." It said Massey management failed to prevent a small methane-gas ignition from turning into a powerful coal-dust explosion. The agency fined Alpha a record $10.8 million in civil penalties.
