A man was arrested for drinking iced tea outside of a convenience store because the police officer thought that he was drinking alcohol. He is now facing charges of trespassing and resisting arrest, even though he did not actually do anything wrong.

I drink both cold and hot tea. I blame my grandmother...A cup of hot tea and teacakes make for some good memories.

:) I grew up drinking iced tea. When my mother decided one year we were going to cut back on iced tea consumption because of the danger of sugar, she caved after everyone rebelled. I no longer drink sweetened ice tea though. The flavor is better without any sweetener.

Tea at my house comes in a teapot, with bone china cups. At work it's tea bags if I can't be arsed using the tea swishy thingy I brought.

I will admit to that sacreligeous stuff called "bubble tea" when it's really hot in summer, I'm out and don't feel like eating. Although let me be clear, there's nothing actually tea-like about it.

I've seen the video. To me it seems like it could be a setup.

Who would be randomly video recording their friend drinking iced tea in a liquor store parking lot, just moments before the undercover officer approaches. Plus the drinker seems to be making sure to drink a lot fast, and seems to be trying to draw attention.

Mistakes were made by both sides:

The officer,
  • Did not identify himself as a police office, presenting his badge at the outset.
  • Should have asked the drinker to hand him the can for inspection, instead of trying to take it. (Yes kiddies, people put liquor in iced tea cans and soda cans to drink it.)
  • When the drinker refuses to hand over the drink, then make the lawful order.
  • If the drinker still refuses to hand over the drink, inform them they are now trespassing and order them off the premises, and give them time to leave.
  • Inform them that failure to leave will result in arrest, and give them a second opportunity to leave. If they refuse again, then arrest.

Plus secure the can for possible evidence.

The drinker,
  • Hand over the can when the officer asks for it. By pulling it away, and holding it away from the officer implies you are trying to hide something.
  • Don't become belligerent or smart mouthed when dealing with police, keep it courtesous and professional.
  • When asked to leave, leave.

Also, the cop needed to arrest the drunk that staggered in while the incident was being videotaped.

He wasn't trespassing. He walked out of the store where he had been a customer and on to the parking lot. If he was trespassing, so were all their customers. According to the videotape, he didn't resist arrest either.

If this was an employee of the store, everybody should boycott the store until they fire the asshole. :(

According to what I heard, he just arrived and was waiting for a friend before going into the store.

The cop was just in the mood to be a hard-ass.

Apparently so, but the situation doesn't change. The accused was about to enter the store, so he was a customer, and he clearly did not resist arrest, especially because the man who accosted him was not even a uniformed cop.

As soon as you tell a customer he is trespassing, he is trespassing, customer or not. He should have given him more time to leave, or explained the consequences before making the arrest.

He challenged the officer's assertion that he was drinking alcohol, showing him that what he was drinking as only Arizona Iced Tea.

He showed the officer the can, the officer was not able to determine what was in the can because the drinker did not hand over the can as asked.
 
Has anyone considered that this is just a brillian advertisement for Arizona Iced Tea?
