Major disappointment in Florida

If a state as family-friendly as Florida USA can't convict our twelve-year-olds to life in prison without parole, who can? Darn that appeals court! The kid is 16 now, and if they had just stayed out of this, he'd only have like 70 more years to go.

This kind of permissiveness sends a terrible message to other mentally challenged twelve-year-old boys.

i hear too that FL is getting a bit slack with the death penalty for perfectly suitable, retarded black teenagers who knew exactly the nature of their crime.

we had a case over hear a few years back where two 11/12 yr old's battered a 3 yr old boy to death in an afternoon of fun and games, it appears they set him up and used him for target practice with rocks before finishing him off later. the boys were caught and sentenced to life inside, they've recently been released now as teenagers, because the european laws don't allow life in prison, it's against a killers human rights it appears to make them do the full term.

the worse part of this story is that the two teens are now living in government protection costing the taxpayers thousands of quid. they had to hide them cos the family of the 3 yr old put a public contract out on them and promised that whenever and wherever, they will be killed for their crime. so of course they have to be protected.

I'm too impressionable by far to take a stand against trying kids as adults. Reading LorriLove's post makes me want to strangle the little bastards with my own hands.

This case in Florida, though, was overturned because the child - and he was a child at the time of the killing, although over-large and with a thuggish look that cannot have helped him in court or in the public eye - was never tested for competency or given a hearing to determine whether he was competent to help in his defense.

The child he killed - a small six-year-old girl who was simply a playmate - died in what may have been a fit of rage, and was never explained by the boy as anything other than "imitating wrestling moves from TV."

Hard for an adult to accept that one could "wrestle" a smaller person to death without intending to kill, but this was a 12-year-old boy whose IQ placed him in the "borderline" range for mental retardation. That he was forced to stand trial as an adult without a competency hearing never seemed right, and now that an appeals court has recognized the error, the boy might end up going free - the outcome his mother and attorneys are hoping for, but not likely to be the best thing for him.

Of course, neither was a life sentence without the possibility of parole.
