Another one that I like, and I've lost it. It's probably in plain sight again.
Husband and wife are having issues. They have three kids - a teenage daughter with a younger boy and girl. At least the older daughter is closer to her father. The other two tend to follow her lead.
Wife is having an affair (I think she thinks she is trading up). They start to divorce, fighting partially over custody. The kids have to meet with the judge privately. The judge thinks the kids should remain together. The husband ends up with custody.
At the end of the story, there is a party that is basically a celebration for the father getting the divorce and keeping the kids. His daughter secretly tells him that she told the judge she came home from school and saw her mother in bed with her lover, and that it really upset her. That's why the judge decided in the father's favor.
